Hi All,
Here is the background.
I stayed up until 1:44 am on Friday morning (March 16th) and pre-ordered the iPad 3 through BestBuy.ca(BB) using my credit card and a gift card that I had been saving for a while.
On Monday March 19th I rec'd a shipping notification from BestBuy.ca
On Tuesday, March 20th and the item was "DELIVERED" (according to Canada Post's(CPC) website). The picture is attached
HOWEVER I HAVE NOT REC'D THE IPAD AT MY DOORSTEP NEITHER IS IT IN MY MAILBOX!
I called CPC right away and they said that sometimes the driver scans it before he delivers the parcel. After an hour (at 1730 hrs) I called them back and they told me to wait till 8 or the next day due to busy routes and other stupidness.
I called BB and they said that this is CPC's fault and I should wait a day and call them back.
The next day...
I called CPC and they said this happens and it will have to be dealt with BB since they are the shipper.
I called BB and asked to speak with a manager, who told me that this is rare but it happens. She said I have to wait till Monday March 28th and if it still has not reached me I should contact them and they can pursue a "lost shipment" case with CPC and refund my money.
I say "Wait a minute. I don't want a refund. I want my iPad 3!"
She says "Sorry we cannot do that. We will refund your money and your very welcome to order another"
I say "EXCUSE ME! WHAT?!? You do not have any stock! What the hell am I going to order!"
She says "Let me check...hmm yes we are out of stock. Well if you order, then we are in backorder and we will ship it to you once we get it"
So I say "So I am placed before all the other orders since I had a pre-order in place before right?"
She says "No, we cannot do that. You will be at the back of the line"
I say (trying to keep calm and polite) "You have got to be kidding me! YOU MESSED UP! WHY SHOULD I PAY FOR YOUR MISTAKE!"
She says "We shipped it...its CPC's fault"
I say "I do not care. YOU deal with that. YOU used CPC. It was not my decision. You deal with how CPC missed this shipment. I just want my iPad!"
She says "I cannot do anything about this right now"
I break my phone in half and curse the entire staff at BestBuy and Canada Post.

Heavy attitude is not going to get you far... there is no grounds for anything in the courts
unless you are not compensated in a timely fashion.
Clearly either someone in Canada Post is a thief, paper trail might weed him out...
Or BB is pulling a fast one... and is allocating Ipad's to advantage, or there has been
a shipping ***** -up... [as noted.. this does happen].
Your circumstances are such, that you need to be calm, trust the system to satisfy,
the gracious solution 'immediate re-shipment' may not be possible due to demand.
There may be some thing extra in compensation if you keep a cool head,
but unfortunately it looks like you're back of the line... but then so is the system
you used... and so many others depend, the credibility of BB & CP just took a hit.

This actually happened to me before.... it turned up 2 days later in my superbox mailbox.... just be patient and it should arrive.

I had the same thing happen with a bluray boxset I ordered from futureshop. I was issued a tracking number and followed the tracking. One day it said delivered when it never was. I called Canada Post, they said the same stuff to me. Waited 2 days. Called Future Shop. They initiated a claim. I ran into the same problem. It was one of the few times a price error was honored. FS wouldn't reorder the item just gave me a rebate.
I suppose it sort of sucks. It's not really FS's fault. They shipped it. Canada Post misdelivered it.
If they don't have any stock they don't have any stock. Maybe they don't have a way to bump priority on orders. It just goes by order # online? You're not going to get anywere being mean about it.
The wierd thing in my case, was someone claiming to work at my apartment building knocked on my door and said it accidently got delivered to the neighbors. It had been opened and everything. I'd never seen the guy before. It was pretty strange.

Thanks for the advice. I guess I will wait until Monday. Knowing my temper, I am most probably just going to be über pissed by then.

It is not Best Buy's fault, so they are not obligated to give you anything or treat you any different from thousands of other fanboys who are trying to get their hands on the new iPad... The most you would probably be eligible to get is a refund on your shipping costs from Canada Post. As per their policy, published on their web site, you have to wait for 10 days to see if the package turns up.

I don't see why you would have any reason to sue. Are you American?
The only error was made by Canada Post. The retailer has no onus to bump you ahead of others, and you have no right to expect it. They gave you your IPAD as promised based on when you ordered. Canada Post lost it. Why should you get your second Ipad before somebody else who legitimately preordered or requested one before you? It is not their problem Canada Post lost it.
You sound like an irrational and unreasonable individual with entitlement issues. You should be happy they are investigating/refunding. Ease up on the roid rage, wait for the investigation/refund, then order another. You can always enroll in anger management classes while you wait for the replacement Ipad.

My bet is we never hear from the OP again on this as it arrives today. Though it does feed my paranoia....I'm about to make a large purchase that will be sent CP.

How can bestbuy ship something worth that much out without requiring a signature, or leaving a "do not safe drop" code? You should question bestbuy about that. Usually expensive stuff from them you can't deliver to the door, it has to go in someone's hand or in a safe compartment. if the carrier didn't do it properly, then yes he should be fired for that. BUT if bestbuy ships it out as a regular parcel, and the mailman just leaves it at your door, that's not exactly his problem if someone nabbed it from there.
Easily solution is use the 'pick up from store" option next time.

And yea, next time instead of bitching at the 1-800 number people on the phone, drive to the local canada post location & ask to speak to a supervisor in person. I'm talking the actual mail station, not the shoppers drug mart retail shop

Eh, calm down, it's rare as stated but it happens. Be patient and wait to get your refund and then buy it from BB again when they have stock.
Plus, look on the bright side, it'll probably end up working out better for you anyway when you get a 2nd production run of the iPad3 with the heating and wifi issues addressed. ;)

There is a misconception with "Do Not Safe Drop"
TECHNICALLY "Do Not Safe Drop" means do not leave it on a porch, or anywhere exposed. If it can 1) fit in the mailbox, so the box can be closed completely it's not considered "safe drop". 2) if you have those community boxes, and if fits in one of the parcel comparments, it's not considered a "safe drop". Both of those are considered secured compartments.
So if by chance the OP has one of those shared community boxes, and one of his lovely neighbours stole the parcel compartment box, he can thank them for his lost ipad.

It seems pretty standard practice from my experience. Apple shipped my $1700 Macbook Pro and $600 iPhone4 via UPS, both times UPS simply left the items by my front door sitting on the porch, and they sat there for 8 hours in the open all day until I got home from work and found them there. No signatures required on anything.
