View Full Version : Sick of work need help on WSIB

I am working for one of the big thrift store for 2 year now in Ontario. I am doing one of the main labor intensive jobs there basically standing in one place all day and opening garbage bags with clothes inside and sorting them i have time limit on how much i have to do . Some of the bags can contain anything from local house hold garbage and i mean dirty nasty smelling garbage like decomposing food and some time medical staff. I alone process about 5000 lbs a day of this ****. So without me and other sorter just the 2 of us no body can to those pounds by the end of the day and pounds have to be done because have to please the controlled who monitors the pounds. When i have to take emergency or sick day i am being looked like i am going to take 4 weeks off, reason for this is that who ever will replace me that day no matter who at the company they never finish the 5000 lbs even thought company is saying that its all about team work and my job is everybody job and people who replace me never finish the pounds and then i have to make them up by end of the week. When i also finish early which is every day i am ask to go and do another job which i can do with no problem but my body is being strained to the limit. I have developed knees and upper and lower back problem it comes to that point where i have to stop to relax my muscles and bones.
Now my question is i went to the doctor walk in clinic and told him about my back problem he check me out and told me i need therapy. My supervisor ask me if i am going for therapy i told her no because i cant afford it since they pay us 10.25 and i have 2- 8 month old girls. Today Monday i called in sick because of my back was locked all weekend and only place i can sleep is floor on my side and she was rude to me saying what are you going to do about your back i told her nothing since i cant afford physio traphy. I don't think i will get fired since they have that 3 written strikes. But what can i do here to protect my ***** if they try do pull some **** on me. Should i go back to my doctor and ask him for back and knee check and to fill WSIB because i can get light duties until i heal how would i approach this? Who would give me WSIB what do i get from my doctor for light duties until i heal. I know people will tell me to get new job but i have 2 kids.
Any advice would be appreciated

I would recommend trying to find a job where you could be sitting.
My friend injured her back and went back to school to change careers because she can't stand for too long anymore. If it's an option, look into that yourself. Your daughters are young so I'd imagine you aren't too old yourself. Don't risk messing up your back any more.

I'm sure you can find another minimum wage job hat isn't as labour intensive. Even if you get Workers Comp, you won't get 100%.

WSIB is to protect employees that get hurt at work. If you need to go to therapy for an injury that happened at work, then WSIB should cover it. Go to the doctor and explain that you believe the back/knee pain is from work and he will fill out a form and send to WSIB.
It is also important that you tell your supervisor you went to the doctor as someone from your work will have to fill out a form 7.

I didn't bother to read most of your post (sorry). But my suggestion is to say you hurt your back while you were on the job. Then you can qualify for the worksafe benefits. Is that what you're asking? Not entirely sure. To process a worksafe claim, you want to call worksafe directly and tell them what happened. Keep it simple, e.g., I lifted a box, my back popped, and I went to the doctor and he said I need rehab. I'm in pain, and can't work, etc. You can also go on EI sick leave for up to 15 weeks. And if you resign from your job due to medical reasons, you can collect regular EI too, since you resigned due to something that wasn't your fault. So lots of options here for you. If you hate the job, then I'd just quit due to medical and go on 1 year of EI (15 weeks sick / 43 weeks regular = 58 weeks total).

i would suggest on your own time, look for another job that requires less labour (department store, fast food, call centre etc). 'cause your health is more important than money. the longer you work this job the worse your back will get.
if possible (and im not sure of your condition), you can always apply for disability (canada pension plan, odsp etc).
