No, even tho they say "win" it really is a freebie/giveaway. It's also one of those get-a-penny-give-a-penny arrangements. Not quite sure why they worded it that way. Some legal thing I guess.

It's not a draw... If you're one of the first 10,000 you get the sample.

They are just covering their behinds... They use the word "chance" because if you are entry #10,001 you don't get the sample.

Since nobody knows how many people entered before them, if they send you a "sorry" email, you have nothing to go against them.

It's uncommon, but not unheard of. You used to see it with some snail-mail freebie offers -- they'd actually send you a nickel, then you'd check a box that said "I agree to pay $0.05 for this offer/sample/whatever" ... but you didn't actually have to send the nickel back.

Some legal thing obviously that makes it a "purchase" rather than a "giveaway," I'm just not sure what the specifics of the legality are. The company is based in Quebec, I don't know if that has anything to do with it.

Seems like you gotta receive 7 newsletters before even getting a chance of confirming anything... so don't delete the emails yet!
