View Full Version : Cheated by Rogers CS! What should i do?

I am very dissapointed with the CS in rogers. to cut the story short, i went to the rogers 3 weeks ago to add on a data plan. I specifically told him that i Do not want a 3 year contract data plan as I need it for 1 month only. He said ok and without taking the trouble to go over the paper (or contract i presumed), i signed the the paper. I admit i made a mistake here. Today, i realised that i was cheated. That CS gave me a 3 yeat contract on data plan! If you were me, what would u do? Thanks

Calling Rogers would be my first point of action
Then again I wouldn't physically go in to a Rogers store just to add something to my phone plan, and I definitely wouldn't sign any type of agreement, based on their track record u might be screwed with a penalty charge, as you have no proof of your conversation, the only proof is you signing your name to a legal contract

mistake #1 i can see. but doesnt look like op waited 3 weeks but rather just noticed what happened 3 weeks later. same thing hapened to me and i had no idea my contract was extended until a month later when i called to inquire about a hardware upgrade (my 2 yrs was up, was going to give the new phone and contract to my brother). turns out when i said yes to the discount id get for being an airmiles member, i also had renewed my contract (even though i told the store rep i was leaving the country in 6 months) therefore unable for hardware upgrade for another 2 years.
anyways, lesson learned. sorry for your troubles op, perhaps you can explain your case to rogers although when i tried that they told me to track down the rep i talked to at the store myself :facepalm:

The only hope for the OP I can see is if there's one of those 30 day cooling off period for a contract if you change your mind. I don't know if there is one but it'd be worth it to find out ASAP since he's 3 weeks in.

I think the usual cooling off period is 10 days for something like this. You could always ask them to show you the signed copy of the contract because if they can't produce it you may be able to dispute it.

I think there's only the Buyer's Remorse Period for returning your device within 14 days or 30 minutes of use, but that's only when you sign up and activate a service with them. OP should definitely try and see what options he has.
OP should have a copy of the contract which he signed right? It should have the signature and date of the employee who signed him up on the 3 year data plan. I would try to make out the employees name and bring it to the attention of a manager from the Rogers store the service was activated on.
It wasn't a good idea to go into an actual Rogers store just to get a data add on and not read the papers OP signed, but what's done is done. Let's just get that out of the way and see if there's anything we can suggest OP to do to help his case.

They will tell you that the CSR would never say that because they don't offer data plans without 3 year offers. You can try to get them to void it, but I doubt they will. Your next step is ask them to investigate the phone call they recorded, but with that I believe you have to first send a written letter in the mail to the GM, and request it.

I was more thinking something under provincial law. According to this link it does exist in Ontario but it's only 10 days however the part I bolded may give hope to the OP if he wishes to file a complaint.
Under the Consumer Protection Act, 2002, you have the right to cancel an agreement and have your money returned to you if:
The contract is subject to a cooling off period. You have the absolute right to cancel (for any reason) within 10 days of receiving a written copy of the agreement.
The vendor has made a false, misleading or deceptive representation about the goods or services you agreed to buy or lease.
The information about the goods or services, or your rights as a consumer required by the Consumer Protection Act, are not provided to you in the agreement.

Since you mentioned your were adding a data plan, I'm assuming you already had an existing phone contract/plan.
Maybe you could try calling retentions and ask them to void the data part of your plan or you'll take your business elsewhere.
Not sure if that would work, but trying wouldn't hurt.

It wouldn't surprise me if they've locked him into a contract for any voice plan he has as well as part of the data plan buried somewhere in the TOS.

as far as i know you can make changes to a contract with rogers, you just can't terminate it.
So you should be able to cancel the data plan on your phone BUT you may have to pay a fee to have it cancelled
have you called them back to see what can be done? that would be the your first course of action rather than coming on to redflagdeals

If the OP's description of events is accurate a Rogers rep intentionally deceived him. If I was him going to another Rogers employee first would be the last thing I'd do before finding out more about the situation.

why? If one employee 'intentionally decieved him' then thats the first place you'd go, to a felow employee or a manager.
case in point, I needed Rogers to make a change to my bill, called, they made the change, got my bill it was the completely wrong change.
I called back, had an intelligent conversation about it and the change was reversed
it wasn't a big deal, with phone contracts nothing is permement unless signed. As the chance was over the phone there is no signature.
OP, have you called rogers?

Worse case they make you pay $100 + taxes to cancel the data plan.
Reality 1st month is usually free or unlimited when adding data on a contractual agreement.
You are past the remourse period ( 14 or 15 days ), so in essense $100 data early cancelation fee applies.
If you did not do a a hardware upgrade as needed data for certain phone, 70% of reps will reverse the $100 cancellation fee, if they say no, hang up and get another rep. Reasoning " They was no reason behind getting a 3 year data contract as no special promotions where used or taken advantage of"

I don't think you have to worry about your data 3 years contract because Rogers just changed their contract cancellation policy recently... You won't have to pay $100 for cancel the 3 years contract for data if you don't get any subsidy phone.
I'm not sure if you have to pay the Service Deactivation Fee ($12.50). Technically you still have your voice plan with Rogers and you don't deactivate your Rogers service.

Just call Rogers and ask to cancel data to see if they will charge you cancellation fee or not.

Fool me once.
Besides the telcos have built their entire business model on short changing customers in this country. Best to avoid them whenever possible.
