View Full Version : Can I get refund from Montreal AMT for June monthly pass

Last year I registered the auto-pay for train monthly pass, thus I don't need to buy it each month. Because of some personal reason I will not use the train next month (June). I called AMT four days ago that I don't need it for next month. They just said that it was already charged (on May 10th) from my credit card, and they will not refund. I understand that if I want to stop current month, I cannot get money back because I already use their service. But for next month, I don't see a reason why they refuse to refund.
Is there a place I can complain and get my money back? Any advice will be appreciated.

It clearly states when the money will be withdrawn and when you must inform them of a cancellation. You failed to inform them properly, there is nothing you can do.
3. Cancellation of membership – The client may cancel his/her membership on prior notice to the AMT Membership Department, in writing or by telephone. However, a cancellation request received between the 11th day of the preceding month and the 10th day of the month (inclusively) shall take effect on the last day of the month (e.g., to cancel a membership effective December 31, 2011, the AMT must have received the cancellation request between November 11 and December 10, 2011 (inclusively); if the request is received on December 11, 2011, the membership shall end on January 31, 2012).
By signing below, I acknowledge that I have read and agree to the TERMS AND CONDITIONS of this contract, have visited the AMT website or consulted the AMT Membership Department to obtain all information regarding the transit pass purchased and the fare categories, and have familiarized myself with the applicable regulations. I hereby authorize the AMT, its representatives or any person designated by it to debit my bank account or to charge my credit card for the value of the monthly pass purchased, between the 11th and the 15th days of each month preceding a membership month, with the understanding that there shall be no withdrawal in the month preceding that in which the client is entitled to, as applicable, a free monthly pass and that the issuance fees for the first OPUS card shall be added to the first withdrawal for a subscriber of a regular fare transit pass. I warrant that all individuals whose signatures are required for the bank account that will be debited, as applicable, have signed below.

It's sucky, but it's in the contract you would have no doubt signed and accepted. You did read the terms and conditions regarding cancellation at least, didn't you?
You can complain all you want, but it appears the AMT didn't do anything wrong in this case.

Credit card charge back. Just say to MasterCard or visa that you did not gave them your authorization to take the money.

This is ridiculous advice. Firstly, it would be a false declaration, since clearly this person did give them authorisation to take the money...they even say so in their very first post. Secondly, all AMT has to do is provide a copy of the signed agreement, and chargeback denied.
Chargebacks aren't just so you can get out of paying what you are contractually obligated to pay.
It's unfortunate for OP, but OP did not fulfil his obligations regarding notice.

can't you just sell the monthly pass? if you provide a discount and post it on cl or kjj or rfd you might find a buyer. Later you can buy a replacement opus card.
If you have the card registered, you could have the old one deactivated after june.
Not really sure if this works this way.
