View Full Version : Odd situation, advice needed

long story short, hired xcopper to represent me for a ticket because the court was in york region and i couldn't go myself. the license plate on the ticket was incorrect and i know this isn't grounds for dismissal in court but it was incorrect + the officer added an extra digit.

xcopper monkeys couldn't get it dismissed apparently and i was convicted for a lower charge+fine. i received the letter in the mail which also has the incorrect plate number written on it. it should be in the form 1234A (motorcycle) but was written 1234AB

my questions are:
1. can i appeal it or get it dismissed somehow because of the extra letter?
2. or if not, and i pay the fine will it come back to haunt me because of the error?


help is much appreciated.

Yes, you can appeal it. I have done it myself, and the circumstances were similar.

I got a major ticket, hired Xxxxxxx (paralegal company who should go nameless). They lost and I was convicted. BTW, I couldn't believe they lost.

So I appealed the conviction, this time I represented myself, went to the Old City Hall in Toronto in front of an actual judge, and won.

Neither the conviction or the demerit points went ever on my record, because part of the process is to contact the MTO to notify them of the appeal. They will not update your record with the conviction until the appeal is completed. If you win the appeal, obviously no conviction shows up on your abstract.

I believe paralegal is not acting at your best interest, they will just go negotiate with the prosecutor to lower the fine and make it low or no pts then leave. This way, they don't have to step in to the court and may save them time? I could be wrong, but I've seen some paralegal acting this way.

I present myself with a ticket putting the conviction reason wrong and I didn't even have to say a word except my name and they threw my ticket away.

Yeah, hiring a ticket fighter service isn't a great idea as they don't fight to get your ticket dropped nor fight for a not guilty verdict, they only fight to get your fine reduced (which anyone can do for themselves by simply going to trial and accepting a deal from the prosecutor before trial starts) and in both cases still results in a conviction on record.

So really by getting a ticket fighter, you are paying them to go to court for you so you don't have too, because they can't do anything better than someone fighting for themselves. In the future, if you get a ticket, start here (http://forums.redflagdeals.com/ask-me-anything-about-fighting-your-traffic-ticket-speeding-parking-etc-1178211/), and fight it yourself.

Some errors on tickets can be dropped on appeal because after a trial is complete, a traffic ticket can no longer be amended (if you argue the error during your trial, the Justice has a right to fix it then and there). So if you find yourself seeing an error like the wrong calculation of the fine, its best to not pay it nor request a fine. If/When you are convicted by default, you can appeal it based on error or law and have it dropped.
