Hi guys so i recently rear ended a lady about a month ago (just a couple scratches on her rear bumper). She got an estimate to repair the bumper and we met up and gave her a cheque. Could i still get sued or could anything still get filed to her insurance or lawyers?

Did you get her to sign an agreement that you hit her and paid of the damages already?

No =/ but i have a conversation throuh text message if that counts for anything that says i would pay for damages.

I wouldn't worry about it. A friend was in a similar situation where someone hit him, and they paid out of pocket for his car repair. Didn't think twice about calling the insurance company or suing him..

BTW, if she was to contact her insurance company, she would need your information and policy number, vehicle, etc etc to file a claim against you. But in the process you would get notified.

This scenario is insurance fraud. I doubt she would attempt to do such a stupid thing.

She could say she was hit in a parking lot, and keep your money, but that would only go on her driving record as a "not at fault" accident.


If you don't mind me asking, how much was the estimate? It seems to me that "a few scratches" can be touched up with a pen actually...

Unless you caved it in, in which a full 750 dollar bumper needs replacing lol.

Could she still sue you? Yes. Could she still go through her insurance? Yes.

Those things probably won't happen though. Not worth it over a couple scratches.

Well she gave me an estimate of 1350 and i was infact driving my girlfriends car so i didnt hesitate to pay it off because my girlfriend didn't want her insurane getting screwed up to. She wanted to get her bumper repainted and it was premium paint or something like that was her claim for the estimate being so high

Even my 335is rear bumper repaint with the special le mans blue color didn't cost 1350. That's with milking the property insurance by fixing up some minor scuffs on the car aswell. It came out to be 1g. With 3 day rental.

You got milked so hard. You shoulda said go through insurance then or take 50% of that quote cash. Bet you she wouldst took that cash at 50%.

BTW insurance buyouts only give you 75% before hat.

+2 - A new bumper costs like 750 doesnt it? iirc from when my wife's car was hit in a parking lot, damage wasnt even that bad, but the clips snapped off, and yeah, 750 for a new one out of pocket.

Maybe prices vary from Hyundai's to BMWs but damn,thats crazy!

Yes you can still get sued, especially if the person decides that they are injured.

also I would save and print out those text msgs just in case something come to you down the road (which probably wont happen) but just to over yourself

$700-800 only. Good Shop, No Tears or Dusk Mark......! Do you hit a Ferrari...?

You should have thought it through and prepared a document that releases you of any further responsibility from the accident. That being said the likelihood of ever hearing about it again is probably small so I wouldn't lose too much sleep about it.

Last year somebody smacked the rear of my lexus, it was raining and dark but they were very cooperative and I told them I'd just take their info and check for damage the next day. When I did, there was a bit of a mar and scratch where their license plate bolts probably were but I felt it wasn't worth making somebody pay for a new bumper or even repainting over that so I just let them slide. I felt it was the right thing to do and I would hope if I ever make a mistake and cause such minor damage to someone else's vehicle they would do the same for me.

Unfortunately, seems rarer these days that that'll happen....everyone wants to make a quick buck

Lol, don't even count that in! people who smack it in a parking lot and just "leave" like nothing happening is more common than someone giving you a break if they smack you.
