I was at a location yesterday wgere the machine was stuck trying to call to their server. I guess someone before me tried to pay and it hung. anyway if you park therre without buying a ticket technical issues or otherwise will they simply write you a courtesy ticket for the flat rate amounr or a 40$ ticket?

Why not call them and ask? At any rate, my logic says you'll probably get a regular parking ticket which you will need to go to court with proof that you were unable to pay for parking to have it thrown out. A lot of wasted time. Reasoning is it isn't a police job to make sure that the ticket machine is operating correctly, nevermind not even being able to know when it stopped operating correctly if it isn't at any given point in time, before issuing parking tickets.

I'm guessing nothing can prove it isn't working short of a video clip that clearly shows when and how it was malfunctioning.

You can call, thats happened to me before. I gave the operator my CC info (I know, I know, but its one of my cards with a low limit) and my plate number.
