View Full Version : bought a lemon from Ontario fine cars HELP!

hi guys, a couple weeks ago I bought a 2000 VW jetta from Ontario fine cars off off Autotrader. Im in vancouver so I wasnt able to inspect the car, but I paid 700$ for a mechanic (recommended by the dealer) to inspect the car. He did and said that it needed new brakes and new brakes were put in. I was told by the dealer that the car was in good condition with no rust, and only one ding on the car.
Skip forward to yesterday, I get the car delivered to me. It is full of dents and dings. the undercarriage is all rusted, the E brake doesnt work, the doors dont close properly, etc etc.....long story short, the car is a lemon after I was told it was fine by the dealer.
What are my options now? the dealer is avoiding my calls, so I know im not gonna get anywhere with that. I could attempt to sell the car but that will be VERY hard. Do I have a legal avenue that I can pursue? What do you guys recommened

Not to be a bastard, but I remember reading the thread when you were thinking of buying it and people warned you. Plus, you paid a mechanic recommended by the DEALER? What the hell were you thinking?

Yeah, have to echo what was said here. I dont think you have very many options as you are in Vancouver. I'd probably either just sell it and cut my losses or pay for the repairs. Then I'd file this whole experience away in my head under the 'bad decisions to learn from' category.

you mean to say you bought a vehicle online without looking at it?
inspection was by a mechanic recommended by the seller?
what sort of contract do you have online? what province? how'd you pay?
you know you're going to get a lot of people saying "what are you thinking, buying a car online?" ;)
you should have a provincial consumer affairs dept and a toll free number to get started...the dealer not talking to you sounds odd too..you may also have a local newspaper actionline type of reporter to turn to
I'd like to hear the other side of this story though

BBB won't do anything though. And that's only if the dealer is a member. Do you have the mechanics' report in paper? If so, *maybe* you have a very very VERY small chance. Otherwise, you are pretty much SOL.

maby the dealer sent another car to the mechanic for inspection , and then sent you the lemon.
anyways its a well know FACT dealers & mechanics are crooks .

Yeah get Silverman from cablepulse involved. Off course he will scold you for being so naive but he will expose the crooks and possibly get your money back or will advise you if you can get your money back and how to do so.Plus the public will be made aware.
Then make sure you do a write up in the newspaper about your experience not to defame the company as they can take you to court for defamation but to inform the general public of the consequences of doing this type of "Blind" transactions reminding them that when it's "too good to be true it often is". Good Luck.
I used to trust people a lot too thinking only good of people but after experiencing some of the crooks and getting burnt by many here in Canada i trust nobody now and I am just a little more careful.

Freight is only around 500$. I'm saving around 4000$-5000$ by buying it in Toronto instead of Vancouver.
I feel bad for you man, but honestly, it's your own fault. At this point, I would say consult with a lawyer and see what your legal options are.

if you have what they told you the condition of the car was in writing, then you have a case. If you have a statement from the mechanic that the brakes were the ONLY thing wrong with the car, then you have a case. You should always get descriptions in writing, or even if you have pictures of what the car was supposed to look like then you again have a case. If it's all verbal, i wish you good luck.

Man, I dont know what people are talking about calling Silverman and suing and sh*t. This is your own fault, I wouldn't consider the sellers crooks. What you did is like a woman on the street just handing her purse over to someone!
Unless you got something in writing from the car dealership stating exactly what was wrong with the car, I don't think you have a leg to stand on.

And yeah, even if you just paid someone a few bucks to run by there and snap a pic with a digital camera to at least see it... that might have been an option.
Anyway, good for the dealer (as long as he didn't break any contracts)! He got a sucker to buy a POS from him. LOL

Have you been to Toronto? There's a reason why cars are cheaper there. People drive their cars fast and hard! When I as there, I was going anywhere from 110-140 on the 401. Trust me, cars in Toronto are driven at least 2 to 3 times as hard. There's salt and bad road conditions therefore rust, and more scratches and dings.

This one takes the cake. Like someone else said, you have no one to blame except yourself... $700 is too much for an inspection... especially from a tainted mechanic.

Uhmm, I'm guessing you didn't get any background checks or ask for detailed pictures? The minimum you should've done was to pay someone from RFD $100 to go check it out...

If you have the mechanics report in writing (which I highly doubt) or the dealers claims in writing (which I highly doubt), then you are extremely limited in your actions.

I feel sorry for ya man, but you gotta use some smarts when buying a car, used car dealers are the slimiest people you'll ever meet.

Everyone saying there's nothing you can do should try putting yourself in his position. Funny thing is these are probably the guys trying to save $10 on a "Stooples" PM and when someone loses a few thousand from a shady sale, they say it's your fault, there's nothing you can do. If you got frauded out of that much money would you just give up and say it was my fault? Although I do agree that he should have been more cautious and got a 3rd party to inspect the vehicle, you can't turn back the hands of time.
What the dealer did was illegal and possibly the mechanic too. I'm no legal expert, so I won't comment on legal actions, but I strongly suggest you consult a lawyer or at least start off doing some searches in Google, Canadian law etc, maybe contact the BBB, RCMP, local police. I also hope you have proof, if you have a copy of the mechanics report or even just an email from the dealer with the report, that could help you a lot. Without any documentation, I'm not sure how far you'd get.
Don't listen to all these guys saying there's nothing you can do. Chances are you aren't the first nor will be the last person these guys take. Hope things work out for you.

The problem is that from the way it sounds, it seems a fair deal. You are getting the end of the stick. But the rust part and the door not working part, the mechanic can still justify the car is in ok condition (ok enough and safe enough to drive). That will be tough to fight in court. Not only tough but also time consuming and expensive.
It is up to you to fight it or just take it as a learning lesson. The very least you should have done is get someone who you know in Toronto to check the car for you.

Trust me..Toronto is a bigger market..If the dealer could'nt sell it here locally? why was he selling on the net? like that?

No there isn't.

We're not wallowing in this person's misfortune, but the facts clearly shows this person did not exercise basic due diligence on the deal and now it's blown up in his/her face. Yes, it's funny how someone will spend more time researching a $100 item at FS to save $10 but blow 12 grand on a "deal" full of red flags.
As to contacting a lawyer, sure go ahead, why not. G'luck with that. My opinion is that it's nearly impossible to prove fraud unless the dealer specified the car is flawless in writing, otherwise how many "ding" and dents in a used car is a matter of perspective.

Wow, sorry to hear. But you were given advice yet you still didn't listen. If you were to stand to save that much money you should've taken a flight there in person or paid someone from RFD to take pics or check it out for you.
But alas, hindsight is 20/20. Chalk it up to lesson learned, an expensive one albeit. Check with your lawyer and see what else can be done about it.

you bought a car from out east and expected it to be rust free. silly west coaster, we dont juse use salt we abuse salt, its everywhere and it eats away our cars. Hence why they are cheaper
Take the money you saved, go to a body shop, have those dings fixed. Get the doors re-aligned. Hopefully its an automatic and you can live without an e-brake but if its a stick, hahah better go to a mechanic and have that fixed.
