View Full Version : Insurance trouble (misrepresentation of information)

Hey i am in a bit of trouble with getting insurance. I am currently a 19 year old male. Back in 2004 December i was involved in a car accident. I was driving my friends 2003 mustang and a truck rear ended me, car was totalled.In the accident I also hurt my back and was planning on doing a claim but after going to a few physiotherapy sessions, i was feeling much better and thought insurance premium would go up when i went to get my own car and insurance so decided not to go through with the claim. The investigator(or what ever his name is ) from the insurance company called me a few times to give a statement to go on with the claim. I kept putting it off because i didnt know what the owner of the car wanted to do. Finally the investigator gave me a deadline ot give statement by or else the claim would be cancelled. I decided i wasnt going to go through with it so just left it. 2005 May my sister got a car and she put me as a secondary driver on the car. In january 2006 they cancelled the insurance for misrepresantation of information. The recruiting for the insurance was done over the fone. She told them we were both G2 drivers. But they recorded as her being a G driver and me as G2. And they said that i didnt let them know that i had a claim denied. And for those two reasons they cancelled it. At that time my sister was going to university and was caught up with school work and she couldnt prove that she did say that she was G2 and i didnt know how to prove myself. We let it go. Now i called up a few insurance companies for a quote and they said they wont accept me due to the misrepresantaiton of information and Td meloche monnex (previous insurance company) says they wont take us back for 3 years. I was told ot shop around with a broker. And apparenly the onli insurance company that will take me is Facility insurance.. and they charge anywhere from 500-800 a month. I dont know what to do.. any information you guys can give me will be helpful. If you guys can refer a good insurance broker that would also be helpful. Thnx for ur time

If that's the case, then you should try to get them to review the tape to prove that your sister did indeed said that she was G2. I would suggest trying to clear the misrepresentation incident up, or else you wouldn't be able to get insurance from any "bigger" insurance company for a few years.

You should have asked someone for advice in the beginning instead of fudging things up and now asking how to get out of the hole. Now you are fcuked. Insurance companies are aholes and will use anything to charge you a higher rate. You can try and clear up your record but with the time that has passed since the incidents and the fact you guys seem to like to let alot of things go and see what happens I dont think you will be successful. My advice is to buy a bus pass and wait the 6 years until those items are off your record. Look at the bright side by then you will be 25 and will be able to get reduced rates. ;)

In all honesty, when insurance companies sign up new business (such as your sister when she first joined) .. they run checks.. even if she had told them she was G licensed.. the check that comes back is always reviewed to see if the correct information is given. So in essence.. its not misrepresentation if the broker working your file didn't review it properly.


Also in regards to your denied claim.. you can always put a claim in up to a year after an accident.. If it was your friends car that was smashed into by a truck.. it would be their insurance that covers the vehicle... and because it is not an at-fault accident.. it would not matter anyways. So i'm not sure how your claim is denied when you decided not to put in a claim.

If they are telling you to go to facility for 3 years, you might as well just try a local broker as they will get you better rates.

Thank you guys for ur help.. a broker is the one who told me to go to facility, for it may be the only insurance company available to me at this time. If any of you have reliable knowledgable insurance brokers in the scarborough/markham area. I would greatly appreciate it if you can give me their information. THank you once again

Hi there,
I am an insurance broker in Alberta... and would just like to make a few comments/suggestions.
First off.. i would get on the phone with the adjuster of the claim, and ask why you were told it was denied. I am not too sure what the rules are in Ontario... but in Alberta you have 2 years for a BI (bodily injury) claim. So, you should be able to tell them not to pursue it as you were fine in the accident.

I thought that Ontario had the "all comers" rules like Alberta... can anyone confirm??
