View Full Version : Ticket for expired sticker on license plate

Hello,
Has anyone gotten a ticket for that before? Mine has Dec 06 expiry. I was away most of the month in Dec, and I just totally forgot about it. Just got pulled over today and was written up for $110!!! That looks like legalized ROBBERY to me!!! People get less than that for running a brothel or something (I don't know. Just venting :) )
Another thing is how do I know that $110 is the actual fine that should be levied on such a violation? The amount field is blank, and the officer just fills it in. Can they fill in what they feel like?
I know that I should have it renewed, but it's like 8 days late.
Is it worth going to court? The officer says there is no demerit points with this ticket. I know I don't have much of a case, but I wonder if I can get the fine reduced....

The amount of the fine is correct.
Although the sticker says Dec 06, it technically expires on your date of birth (or the date of birth of the person the car is registered to).
Those tickets are pretty black and white in my opinion. Either it's valid or it isn't. There isn't any judgement call on the officer's part to justify an offence, or any device used that must be calibrated. Also it can be checked with the MTO files.
Maybe someone with experience can fill you in on how to fight it.

The fact it is expired is cause for your fine and unless your birthday is 31 Dec, you are more than 8 days late. The sticker expires on your birthday. Ontario is very lenient in that they generally give you till the end of the month and then the fine is only $110. Quebec will nail you for $450.
No robbery here, just the law. Imagine if you smacked into someone with an unregistered vehicle? Or someone smacked into you? It would negate your insurance and your fines and expenses could be even higher.

BTW, shouldn't I have gotten a form in the mail for the renewal? I remember getting one last time, and had to go do emmissions test. Didn't get anything this time - that's why I didn't even think of it.

you should have gotten a letter (but not getting one isn't a reason for not getting your sticker). if you didn't get the letter, verify the address on your licence is correct.
if you need a driveclean, it depends on the model year of your car. Since renewal was for 06, your car needs to be 01, 99, 97 (or older, odd years only). if it's 02 or later, you don't need a test.
remember, model year, not when you bought the car.

I got hit with that with my first car. I moved at the time of my birthday, and either didn't receive or lost the notice that came. No way to argue it.
Pay it and forget it.

I've driven with expired stickers twice without being "caught"
First time, I forgot to get the sticker for mine, drove for about 6 months without a problem. They didn't give me any hassle at the MTO office, just charged me for the full year(which is what they're supposed to)
Second time, I got the sticker from the kiosk and put it in the glovebox because i didn't have a screwdriver on me at the time. Two years later, I get the new sticker, and wondered why it said 2004 on the plate when i'm about to put the 2006 on.. found the 2005 sticker in the glovebox.
Now I make sure I put it on right away, I bring a screwdriver with me on the day I get the sticker so I can't forget, and change it in the parking lot.

I have a bad habit of getting my sticker in time, but then not putting it on. Mine expires in Dec, and usually my plate is covered in salt and road grime, so I have to wipe the sticker area clean for it to stick, which I never seem to have towels handy for. I've been pulled over for it a couple times, but I show the cop my sticker and he lets me go.
I'm going to have a small problem this spring with my sticker, though, on my summer car. It's due for it's last emissions test (20 years old), but it's been in storage since October. When I take it out in April, I can't get the new sticker until I get the emissions test, but I can't get the test without driving it to get there, with an expired sticker. I'll just take my chances on it, obviously, it's just that the car tends to get a lot of extra special police attention.

My birthday was in July and only put mine on over the weekend.
My car was stolen a couple of weeks ago and they just found it last week. I found it very funny that they didn't write up a ticket for driving with an expired sticker especially when I know they looked at the car very carefully since they dusted it for fingerprints. It sucks that my car was stolen, it would have been worse if I got it back with a ticket after having to pay the impound fees.
I have those blue license plate covers that you can get from crappy tire so that might have been the reason why they missed it.

In Quebec, there is no such thing as a licence plate sticker nor a licence plate at the front of your car....but of course that would make too much sense for Ontario since both are a complete cash cow for government.

court ? A defense of "..I forgot.." is not going to stand up in court so just pay the fine and repeat to yourself ..."b-day..sticker..b-day...sticker...etc

Call up the court and get a First Attendance Meeting. The date should be a few months away.
The day you meet the prosecutor take a picture of your rear license plate (with a valid registration sticker). Present the picture to the prosectuor and come up with some B.S. excuse like you were out of the country for a long period of time or the car isn't driven regulalry. The fine/case will in all probability be withdrawn.

GO see the JP and ask for a reduction of the fine .Tell the truth .YOu were busy with family matters for Christmas .Show the JP that you emediatly bought the sticker .This should reduce your fine in half .

I just got fined for the same thing, it was my dad's car, but the officer said, renew the stickers then stick it on the ownership and apply for trial and then present them with the ownership with sticker and 99.9% you'll be off. But I read here, that it cannot be fought?:S

you should be able to get a trip permit on the car for the 10 days to take it in to get it tested.

I renewed the sticker a couple days ago at the MTO and they said that the emission test notice is no longer sent. Check your stickers and have them renewed before they expire and don't rely on them to send you a notice cause it'll never come.

If I'm not mistaken, they usually mail the letter to renew, about 2-3 months even before your birthday comes up.

I was in fact out of the country for work most of Dec (and my permit sticker expired in Dec.) I never got a letter for renewal, which seems strange to me because I always received a letter, especially since I have to do emissions test. I generally do a 2-year renewal so that I don't have to do this each year.
So I got everything done yesterday (emissions test, sticker). I think that I will go to court to ask for some leniency and see if the fine can get reduced or even eliminated.
While I did forget, I was relying on a letter to remind me - a letter I got each time, at least 3 times before in the last 6 or so years. The fact that the system changes on me suddenly is not entirely fair... (I've now put a reminder 2 years ahead in my Palm to remind me. :) )

Relying on a letter and then not receiving that letter and then blaming the system is totally not fair. You should be aware at all times of when your plate stickers and license are about to expire. I know it is easier said than done but you can't blame the system because you forgot.
I think we have all gotten used to these little reminders that come in the mail and when they don't come we turn around and blame the system because it failed us. Consider yourself lucky that you even receive the reminder because the government doesn't have to send them out to you. Nowhere does it say that a reminder has to be sent out.
If you got fined, don't whine about it. You are the only person to blame as it was you who should have known when those stickers were going to expire.
You can fight it if you want, but don't be surprised if you lose.

ahaha it really depends on the cop.
I had mine expired in July 06 and i was caught on october 06
pulled me over and asked why.
my excuse was "cause i just moved to mississauga from markham and i was busy these months"
he probably didn't give a rat's @ss, but i was really polite to him( meaning talk in a friendly-sorry voice and do as i was told like bring out proof of ownership and insurance and pretending to do it as quick as possible by struggling a little) and in the end he gave me a warning ticket. basically i had a week to renew it and bring it to the nearest police station with proof that i renewed it(receipt). and i was off the hook :D

I would say the system technically did fail us. Systems are suppose to be consistent. So either send it or don't send it. Don't send it regularly for YEARS, and then suddenly stop this time around? People I talked to (live, not on forum) were surprised that I didn't get the letter.
Ultimately, I agree that I am responsible. I'm not really fighting it or lying about what happened. I'm just going to check if there is any leniency. If not, tough on me. But $110 is quite a bit of money. If people surfing RFD try to save two bucks on a bag of chips, why shell out the "full" amount when you may not have to... You never know till you ask.

I must have been lucky. I got caught with a sticker that was 6 days expired and the cop told me, if I had another way to get it besides driving that car, he would give me 48 hrs to provide proof that I bought one. I took my wife's car got the sticker and was excused without court. Like I said, lucky.

just an fyi, they've changed the rules. cars older than 20 years are no longer exempt.....believe it was effective beginning of this year.
i drive an 87 and was sad to learn my last driveclean wasn't my last one at all :(

Mine is an '87 as well, it's anything '88 or newer that will now be exempt. Not that I care much anyways, really, my car has only 100k km and runs perfectly, it passes easily every time. It's just the hassle, really, and the $35.
I do agree with slim shady, though, I don't really think they ever should have had the exemption. What ended up happening is guys would buy old Mustangs like mine (or any performance car) that were 20 years or older, and then rip off all the pollution controls to gain some more horsepower. Mustangs back then had FOUR catalytic converters, imagine how much pollution they must spew with these all taken off. I don't think that's right that people can get away with that.

The exemption for 20-year-old light-duty vehicles is ending as we begin to focus more on the vehicles most likely to pollute. All cars, 1988 model year and newer, will require emissions testing until they are taken out of service. These vehicles would have had their last test for registration renewal in 2007, when they were 19 years old. They will now need to continue to be tested in 2009 and ever two years after that.

Cars are considered light duty vehicles. However, that doesn't change the fact that vehicles 1987 and older will no longer require testing. Perhaps you misunderstood the wording. All vehicles 1988 and newer will require tests, forever, that's what they mean.

i just got my ticket tonight for an expired sticker.. i didn't know that it was already expired because it is my husband's car and he is out-of-town most of the time.. it's our first year here in canada and i didn't know that i have to renew the sticker... in my country we do it every 5 years :razz: but there is no excuse for not knowing .. it was really our/my fault.. my question is > is there demerit for this offence? i really want to have a clear record when it comes to my driver's licence... as much as possible.. i hope somebody could answer my query..

No demerit points, no insurance repercussions, as it's not a moving violation. Just a fine.

Yes you can, funny that you brought this up. A co-worker of mine just did it this morning. He forgot to renew his sticker which was up in November and went to renew it this morning, and they could not issue him one since he also had to get a drive clean test done. So they said they would issue him a trip permit for $15, and that gives him 10 days to get his drive clean done and go back to renew his sticker, without worrying about getting a ticket for an expired sticker.

Only commercial vehicles get the whole month to renew the sticker.
The notice is mailed to you, treat it like a bill and pay it right away.
No wonder it takes so long to get thru the courts, with people clogging it up with tickets for ignorance.
pay your fine and move on.

$110 and you complain??? Consider yourself lucky not to be living in QC... at least for this. I got nailed 2-3 yrs back.
Mine had expired about 7 months and I never renewed. Generally I receive the registration paper by mail, unfortunately I moved and there was a post office stike at the time and never received it and I had completely forgot about it.
Anyways, got nailed for $440 and I asked the officer if she was joking... she said "No, consider yourself lucky... I should be impounding your car right now, but I'll let you drive home. Leave your car home and get the registration done."
It was late and I was on my way home from working out... should have stayed home that night.

Once I started driving the car again, I bought insurance, but it wouldn't pass e-test. I had a temporary permit, but that expired too since the mechanic was taking forever to make it pass. That's when i got the ticket. The cop wouldn't hear about the part that car wouldn't pass the e-test and still wrote me the ticket. They still didn't fix the car enough to pass and i got the sticker with the exemption. Went to talk to the prosecutor after that. He only asked if i had a valid sticker now, and gave me suspended sentence: no fine, no demerit points, just conviction on the record.

MTO always send the letter out. At least, for the past 20+ years, I have not missed one. If you did not receive that, it means it is lose in mail, someone in your household picked that up, etc. I think the letter comes 2 or 3 months before my birthday.
Remembering to renew the sticker is not hard. I assume everyone can remember their own birthday. This may be a big assumption but oh well. Anyway, I don't renew my sticker to be a 2 year sticker. Reason 1: I don't like to give money to the government early. Reason 2: it is easier to remember to do that before my birthday every year instead of every 2 years.
I don't know if it is a climate change or people mutated or something, a lot of people these years have expired sticker in their licence plate. I always can spot at least one car with expired sticker in any parking lot. I always can spot at least one car with a expired sticker when I drive to work in the morning. It is only a 10km drive. One may think those must be a beat up car. No, I saw expensive kind of new car with expired stickers. One may think those must be young people. No, I saw 30 something adult driving a nice car to delivery his beautiful nice dressed small kids to a soccer dome.
Besides expired sticker, I saw people put the sticker in the wrong corner. It should always be top right. I also saw a person put the sticker on the plate protector instead of the plate.

can somebody confirm that this would have no effect/impact on my insurance?
Last week I got pulled over for an expired license plate on a car my sister's car (which she lent me for the week since she was out of town)...
As some of you said, the cop told me that if I went to court with the renewes sticker he would waive the fee for me...can somebody give me the specifics on how the appeal works?
Now I'm not sure if I should go to to court or not - is the appeal process time consuming and tedious? I currently work full-time, so I'll probably have to take a day off for this...(my sister offered to give pay me the $110 if I didnt want to go through the court appeal process)

I just done the vehicle registration part in Ontario (moved from QC).
I got the notice of vehicle registration from QC SAAQ, the payment due date is Jun. 30, 2008.
I have registered the Ontario license plate on Jul 2nd because moving on Jun 30th and office closed on Jul 1st. What should I do with the SAAQ notice? Will they charge me any penality?

Couldn't figure out what he was doing, until I got a $430 ticket two weeks later. Predators preying on the forgetful. And yes there are legit medical reasons that cause forgetfulness.
I will never spend another tourist dollar in Quebec again! Too bad because the people are great!

Could have been worse...we had a warning a few years back that since we park on the street, an expired plate is interpreted as abandonned and treated as such.

on that note, since quebec requires winter tires, how much is the ticket for driving there with all seasons from ontario today when it's the 3rd day of spring? maybe they'll scour the parking lots too for this :D hence maybe another $430? :cheesygri

If your travelling in Quebec, make sure your plate sticker hasn't expired by even one day. Quebec police aggressively patrol public and private parking lots in search of expired ontario plate stickers. Ontario police usually don't bother until the following month, but that is not the case in Quebec and the fine is $428.

I just got fined for the same thing, it was my dad's car, but the officer said, renew the stickers then stick it on the ownership and apply for trial and then present them with the ownership with sticker and 99.9% you'll be off. But I read here, that it cannot be fought?:S
Would I be better off, showing it at a police station?
got a ticket for it the other day..the cop told me the exact same thing.
scheduled a court date already...we'll see what happens!

I was actually pulled over once for an "expired sticker". My sticker was a March sticker and it was still March (a few years ago). The officer let me off with a "warning". Aren't stickers good until the end of the month on the sticker?

No, they expire on the plateholder's birthday.

there should be 7 day grace period after your b-day to renew the sticker, check the traffic law book

Got a notice in QC while my car was parked. Couldn't read what was it about as there was a wet snow and a paper was damaged. It was the last day of February and I renewed my plate sticker that day. Yesterday get a paper in my mail that I need to pay $450 fine. Read this thread and now I know that stickers expires on the b-b-day. My b-day was 2 days before I got ticketed.
Is there any chance I can fight the ticket or lower the fine in QC? Any experience from RFD members?

If your travelling in Quebec, make sure your plate sticker hasn't expired by even one day. Quebec police aggressively patrol public and private parking lots in search of expired ontario plate stickers. Ontario police usually don't bother until the following month, but that is not the case in Quebec and the fine is $428.

And remember, Quebec Police can shoot you with impunity. Especially beware if you came to town for a carpet laying contract, and are asleep in a motel....

Same thing happened to a co-worker who parked on the street and thought he had until the last day of the month to renew. SURPRISE, you have to renew by your birthday! As he was whining about the ticket, I was chuckling under my breath, since the guy is a gashole anyway...:cheesygri
