Hello Everyone,
I need someone's wisdom for a trial that I will be attending within the next couple weeks with regards to an accident I was involved in, I was deemed the driver at fault because I was the car behind and was slapped with a FOLLOW TO CLOSELY TICKET. My accident was May 2007 and my trail is March 2008, so I wouldnt be able to use the charter of rights limitations clause so what else can I do.
What can I do? HELP!!!!

I'm assuming you rear-ended someone, in which case I hope they find you guilty. You could easily hurt or kill someone while on the road. Next time pay more attention to your surroundings.

Given the fact that your only strategy mentioned is a loophole (limitations period) and you do not list any relevant circumstantial defenses, were you really following too closely?
If so...
I'm assuming you rear-ended someone, in which case I hope they find you guilty. You could easily hurt or kill someone while on the road. Next time pay more attention to your surroundings.

If the officer did write FOLLOW TO CLOSELY on the ticket, just tell the JP that it should be FOLLOW TOO CLOSELY and you should get off on the technicality

Not much you can do if you were following to closely and rear-ended someone.

1. Go to trial and pay fine
2. Apologize to the other driver
2. Dont tailgate ever again

Nice find.
As for the nasty responses, it's justified. This isn't your typical speeding ticket. I'm the first to admit that I speed, roll through stop signs at times, etc, etc, etc. I'll never tell someone not to do those things. But when you rear-end another vehicle, that's extremely careless and could easily hurt and/or kill someone. I just don't see how people rear-end other vehicles. Surely people watch the road while driving don't they?
