View Full Version : About accident on QEW/Niagara yesterday

hi folks,

Yesterday while I was driving towards niagara, I decided to stop at timmy's for quick break and when we get back on road, on the ramp, which merge to qew I slipped into the ditch. Passenger side was facing toward wet mud downhill. And driver side were facing uphill.

I was driving with 3 of my other small cousins (7,9,11y/olds). Fortunately, no one hurt, we managed to get out of car with help of other 2 fellow canadians. Hats off to them (damn, i wasn't one of them earlier days, now I know to pull over if some in need of help).

yea then cops came in, called the tow truck who came like 2 hrs later, remember this was at noon in qew/niagara, to be exact it was on exit #57. (IT WAS ONE OF THE HOTTEST DAY).
Tow truck finally arrived and pulled the car from ditch. Fortunately passenger side were all muddy heavily only(I guess). The car started really fine and seemed no other issue while I drove to/from cherry pickups.

i had never received any speeding/driving ticket so far yet. The OPP.Officer said "u r ready to leave now". I took the car and gone for car wash at exit#58 i guess. OPP didn't say anything to me.

Now my question is, would I get ticket or something over mail? or whats the worst thing or good thing I did? anything I forgot to mention about this accident, please reply with questions??
I am not looking for annoying funny(for you only) replies.. Genuine replies only, thanx alot in advance.

hm to be honest...it doesn't seem like you've broken the law at all...
the only payment you would probably have to make is to the tow truck i believe...
the OPP was there as far as i can tell to divert the traffic and i guess its their duty to keep the roads safe for both you and other drivers right?

i guess if you really want to be safe, just phone the OPP and explain your situation...but i see no reason for any charges from the OPP

I don't understand why he should call the OPP. If he was going to be charged, he would have been charged on the spot. Why call and invite trouble?

If they're gonna bill you, they will bill you. And you can take it from there.

btw how did you manage to hit the ditch?? >:(

OP, perhaps you should consider taking more driving lessons.

I know that nobody likes to be criticized, but there's absolutely no reason for someone to simply fall into a ditch. You could have seriously hurt one of those young kids who were in the car with you.

I'm a State Farm agent. If the cop didn't issue you a ticket on scene, they can't just mail you one so you're ok as far as that is concerned.

Although, if I was the officer, I probably would have issued you a careless driving ticket. Vehicles just don't fall into ditches, especially with 3 small children in it, geez, pay more attention out there.

as soon as I made the accident... I was shocked of the accident and was tring to calm down...but with in minutes, couple of while ppl pulled over and helped us get out of the vehicle.... and also made a call to 911 to get some help...

how did i hit the ditch? well... i was distracted by my cousin who was sitting in passenger seat... one of my cousin were having ice cap from timmy's and spilled few around/on him... and I tried to pass the tissue box from the side while taking a turn, which merge into qew... vola, next thing is i found myself into the ditch...

Distracted driving is just as dangerous as impaired driving. We all have our "blonde" moments, so don't feel too bad, but what the others are saying is true. You don't just fall in the ditch, you need to be more careful on ramps.

I don't think you needed 911's help on this one. Unless one of the kids was seriously hurt, you wasted 911 operators time and the officers time. Should have called *OPP if you really think you needed an officer. Next time just call a tow truck. Unless your accident interfiers with traffic or another vehicle is involved you really don't need an officer.

first you drive your car without engine oil, now you drive your car into a ditch because you had to pass some kleenex.

This is what I'm shocked with. So basically you have seen people on the road in need of help before and you didn't bother stopping to help them? The fact that you mentioned that "2 fellow canadians" helped you, which you sounded some what surprised, tells me that you're an immigrant. Correct me if my assumptions are wrong, but this kind of sickens me and you're not the only one out there. This past winter, during one of those really bad snow storms at 3am, I was stopped at a light along with another car. When the light turned green I went but the car slowly started to slip down the hill (probably had bad tires, even though it was a fairly new TSX). I turned around and helped him push, while my gf drove the car. The poor guy was shivering because for some odd reason he decided to drive with no winter jacket so I gave him mine. I kid you not that at least a dozen cars past by us before someone else joined in. I just can't understand what those people who just ignored us were thinking. It's quite sad what this city has become.

Notwithstanding the fact you managed to pull this off, I'm still not sure how simply handing someone next to you a tissue ( box ) would cause you to actually drive your care into a ditch.

How fast were you going ?

Did you take both hands off the wheel ?

No, they can't mail you a ticket, but they can show up at your door up to 6 months after the incident and serve you personally.

A little late but did no one else catch he has a child in the front seat who was under the age of 13? That's a big no-no OP, especially if you have a passenger side airbag.

No the only charge that the officer could have laid was careless driving but he/she didn't so you are fine in that regard. No ticket.

Did you take both hands off the wheel ?

You don't have to go very fast to land yourself into the ditch if you lose traction in the onramp, which can quite easily happen if you are distracted.

In Ontario the officer has 30 days to issue a Part I offence notice with preset fine, or 6 months to issue a Part III summons with no out of court settlement.

What relevance is being an immigrant anything to do with stopping someone in distress? I have a month old daughter, and if I saw someone in distress on the road, my initial intention would never to pull over and see if they're ok. I may dial 911 on my cell to advise of the accident, only after I have pulled over safely to ensure someone doesn't ram my vehicle from behind.

There are certain circumstances that does not allow someone to stop, for whatever the reason, and believe me there's a myriad of reasons why. I commend you for stopping a fellow in distress, however by your 'immigrant' statement leads me to believe that you're more ignorant than the OP who knows few laws about child safety in Canada.
