View Full Version : Homeowner wants $30 to take a fall picture outside the house

I took a drive on Leslie St. just south of Stouffville Road, and there is a nice fall scene of bunch of trees in full bloom near a nice white fence. I stop my car on the side of the road, and this guy sitting in a pickup truck tells me it is private property and tells me I can park on the side and there are signs about photography there.

So I walk over to the sign and it says that the cost for admission is $30 for fall pictures.

I read the sign, turned to the owner and asked him "so you want $30 for people to take a picture?" He replies that people keep dumping coffee cups and tracking over his property, so he wants to be compensated. I just told him "yea right!" and just drove away.

Is it me, or does this sound like a cash grab?

$30 May be a bit much but he should get soemthing.

This is incredibly common for wedding pictures, but just to take a picture of someones backyard seems like a bit of stretch. Although I doubt there is anything he could do to stop you, if you are not on his property.

If you take the photo from the road he has no right to charge you. Maybe it was a suggested donation?

I can see why he'd be upset...but if you really want to get back at him :evil:

Call CRA....if craft sales need to report income, so does he :twisted:

I doubt he could stop you from taking a picture of the scenery...too bad if his house gets in the shot. As long as you're not on his property, he can't remove you or refuse you standing there. You can post the pics too as long as no person is in the shot or you don't post the address.

He can't force you to pay him anything and he can't make you leave provided the street isn't considered private property. With that said, I see his point about people littering on and damaging his property.

Sure, you could fight him on this issue and take the picture anyway, but why start a fight with the guy when all he wants is peace and quiet at his own home. There's plenty of places to take fall pictures, be the bigger man and take a picture elsewhere.

It's actually not that funny...plenty of craft sales have been told to register, charge GST and pay up on their 'income'. Why should this be any different!!??:confused:

I think it is ridiculous that he's trying to charge for something. He's not providing a service or a product so I'm not sure what he's charging for. He's not charging an 'entry' fee since the person was not on his property.

well if he has a sign...likely he's getting some much traffic that as a homeowner, I too would be ticked with ppl coming on to his property

Taking a picture of his home from public property (ie, the road) is fair game. Taking a picture of a part of his home where you might be invading his provacy (ie, his back yard or living room) not so much.

To be honest, I don't see the problem with him asking for money though. If he has a beautiful home and wouldn't mind being compensated for people taking pictures of it that's up to him. Just because it's legal to point a camera at his property don't mean you shouldn't have any respect for the fact it's HIS PROPERTY.

Either pay the guy, or go and find any number or other nice examples of fall colors and take pictures there instead.

No, and you people are missing the other possible point in this which is to discourage people from parking in front of the guy's property, creating traffic outside his house, littering in the area, stomping all over his grass and having perverts peer into his home. His hope is that when people see the "$30" sign they'll just drive away.

And has been said here a few times. As long as you dont step foot on his property he cant enforce any type of fee.

No, I just drove away. I found better places to take pictures and I encourage everyone to NOT pay this guy.

So has it been resolved as it wither it was his private property or not? Ill be up there tomorrow...taking pictures in the area.
