This is in reference to this thread (http://74.125.47.132/search?q=cache:6fwARD90WgwJ:www.redflagdeals.com/forums/showthread.php%3Ft%3D728391+higherlearning+ipod+to uch&cd=1&hl=en&ct=clnk&gl=ca&client=firefox-a). I used the Google cache because the OP has now changed the initial post.

Day 0: Tuesday May 5th
I sent $210 via PayPal (linked to my CC) and notified him.

Day 1: Wednesday May 6th
He told me he had received the money and that he would ship the iPod the next day. In a second message, he informed me that he was located in Toronto.

This is the last time I heard from him. He did not provide me with a tracking number.

Day 3: Friday May 8th
Sent a message asking if he did mail the iPod.
He did not reply to this message.
I have confirmation that he read that message about an hour later.

Day 8: Wednesday May 13th
Sent another message asking when did he mail the iPod.
He did not reply to this message.
I have confirmation that he read that message less than an hour later.

Day 9: Thursday May 14th
Sent yet another message, kindly asking for an update. I told him that I could see he had read my messages. Informed him that if I did not hear from him by friday, I would file a dispute with Paypal.
He did not reply to this message.
I have confirmation that he read that message the next day.

Day 10: Friday May 15th
I filed a dispute with PayPal and it automatically escaladed to a claim. I'm not sure why. He has until May 25th to reply, but I have a feeling he never will.

--------------

I don't see his address in the transaction details, but I was pretty sure I had seen it when I sent the money. So I went to the "Send money" section on the PayPal website, and when I entered his email address, I got the following message: "This recipient is currently unable to receive money."

Could this be because of my open claim, or does it look like he's having trouble with other people too?

--------------

Googling the username from the pictures in this thread (http://www.redflagdeals.com/forums/showthread.php?t=728414), I was able to find that he's banned from another forum (solecollector.com) because he posted fake transactions.

He's also a member of another forum (bullshido.net) but he's not doing business there.

--------------

I'm frustrated because I wanted that iPod for our trip to the UK next week. The PayPal claim will probably not be resolved before I leave. I would buy another one from Apple (since they have now lowered their prices), but I don't want to end up either stuck with two iPods, or not be reimbursed by PayPal.

I'm not sure how this could possibly happen, but if PayPal does not refund me, can I still call MasterCard and reverse the charge?

I wouldn't count on Paypal refunding your money. The seller most likely emptied his Paypal account. I had a similar problem like this a few years ago and lost $500. I did however recover $400 because I requested MasterCard do a chargeback, I had to send them proof that I had been scammed but at this point that's your best bet. I highly advise you to call MasterCard ASAP and explain your situation. They are very good in helping you deal with fraud cases.

As for the seller, don't hold your breath that he will be sending you the Ipod, if he reads his messages there is no reason not to respond to you unless he's trying to avoid you. Take your chances and and try to recover you funds, the sooner the better.

PayPal is still "awaiting other party's response". It says the seller has to respond by May 25th, then they will review the case. Should I wait until that date to call MasterCard?

According to PayPal, his name is Richard Lee. The email address he gave me has this name in it.

Unfortunately, I don't have his address, but I remember it was PayPal confirmed.

Which you do you think is a fake name, Richard Lee or Benson Wei?

I guess I will contact MasterCard tonight instead of waiting for PayPal to resolve this.

Disposable email. His photo album is the same as he's used before for previous scams.

OK, thanks for your time.

The problem is that I'm going to Europe next Wednesday and I would really like to have an iPod Touch with me.

As I said in another post, PayPal will wait until May 25th for the seller's response. I'm leaving two days later, I won't have time to buy another one before leaving.

If I order an iPod today, directly from Apple, and PayPal ends up refunding me, no problem. If PayPal does not refund me, I call MasterCard and have this charge reversed.

One way or another, I fail to see how I would not get my money back. Right?

The only scenario where I would be ****ed is if I order one from Apple, and the seller ends up shipping his iPod at the last minute. I would be stuck with two iPods. But I guess chances this will happen are slim to none?

What would you do?

Paypal is not going to refund you unless the seller has enough funds in his account, which is very unlikely since scammers know to withdraw their funds before they are held. Request the chargeback with MasterCard but DO NOT inform Paypal of your intentions, for some reason they do not like it when you do chargebacks with Paypal transactions...most likely because they will end up being at a loss.
Go on your trip to UK and by the time you get back MasterCard will have sent you a confidentiality form which has to be signed and returned to them, and from that point then they will start their invetigation. It does take some time but eventually you should be refunded the amount that you've paid.

I know where Shaw street is, it's in the west end of the city. Somebody really should knock on his door and speak to his parents about his online activities he looks like he's still a kid. Maybe then can set this kid straight.

The chance of this jerk shipping you an iPod is none. It is not even slim.

Do the charge back ASAP.

Go buy another iPod and enjoy your trip. This jerk has screwed too many people. He has to be stopped

I called MasterCard and they said I have to wait 30 days before I can ask to reverse the charges.

I got a reply from PayPal regarding my claim:

Dear XXX YYY,

We have concluded our investigation into your case and have decided in your favor.

We were able to recover $203.61 CAD and this amount has been credited to you. Please allow five business days for this adjustment to be posted.

If you are due any additional funds, we will make our best effort to recover the balance from the seller.

If the seller's account has insufficient funds to complete the refund owed to you, please be assured that we will take appropriate action against the seller's account, which may include limitation of the seller's account privileges.

I'm not sure what this last sentence means, but it looks like my credit card has been credited.

I guess everything worked out. You only lost $6.39 and it's pretty good.
Btw, when sending payment through paypal always use "Goods". Never ever use "Services/Other"

Yes, please have your friend look out for this idiot since you "dun remember seeing" him.
Why would you bump up an old thread and have your friend give him a smackdown when the issue was settled almost a year and a half ago?
