View Full Version : What should I do??

I met with a "buyer" for a battery I'm selling, but it ended up being someone of a previous purchase. A camera I sold from Kijiji 5 days ago.
user name: http://www.redflagdeals.com/forums/member.php?u=40044
He told me the camera I sold him has some line in the picture, I cannot see it but I right away offer to buy the item back same price. but he said no and said "that's not how I do it"
He threaten to charge me 150 dollars to get it repaired and report it to police, I offered to buy it back again and he refused and said he "needs to talk to his lawyer friends" and "will call you later".
Now, he never called or text me on my phone (he said he emailed me, but I don't really check it due to "Nigeria buyers" emails). I have 20+ positive feedbacks and definitely is not a scammer.
Also, I don't think it's right to call me out pretending to be a buyer for an item he has no interesting of buying
What should I do?

Since you offered to buy back the camera and he refused, I don't think he can do anything else, but then again I'm no lawyer. Check your e-mail see what he said. Sounds like the dude is being a ***** or trying to scam you $150 for a supposed repair fee.
Offering the refund is the only thing you should do. Don't even offer a penny for fixing the camera.

You offered the refund, he refused. Case closed. His own problem now. You don't need any further contact with him. Lawyers and police can do nothing in this situation, so don't feel threatened.

well, he took time testing it and now there is a problem, I have no problem buying it back and then send it to repair to Sony.
I mean, I've had issues with other users before about manufacture defects before. But never before had people accuse me of trying to scam them and wants to report it to police instead of trying to solve it.
*sighs*, I PMed the person the person, and he refuses to talk to me, I will give him 7 more days for a full refund. Most camera stores have 14 days return policy too.
that sounds fair, right?

This guy is just a dumbass, let him do his crap.
I highly doubt law enforcement officers or lawyers, to say the least will take up petty ordeals like this one.
Seems to me he's just trying to make a big deal out of it.

Sounds like he was trying to extort you. Post what info you have on him, and I'll see if he has a history of *****gery, here or elsewhere.
Is his name Tim Mui, by any chance?
Interesting. We have another user named timmui.

What is the cops/lawyers going to do? Anything you buy second hand is buyers beware. You didn't break any laws in selling him the item. Unless it is stolen or something, he has nothing on you. Let the 7 days pass and ignore him. If he manages to get something on you then you deal with it. For now, just ignore him.
Ok I am officially scared of JAC now. Remind me to NEVER EVER rip people off in RFD.

Like others mention to you, you took your responsibility to offer a refund on his purchase, he must be dreaming to ask for another 150$ repair fee.
Let him contact his lawyer or police if he think it is the right way to solve this issue.
*Even he agree to accept your refund, make sure it is really YOUR camera and not an identical camera but defected.

No, I just hate people like him. You did the stand-up thing and offered a refund, and he tried to scam you.
Is that him in the photo?
Mods, could we please have an IP check between crazycap and timmui? I found a connection in another fourm, and both members are in North York.

Well, the issue is, I can't find my receipts at this point, But I have faith in Sony will take back their camera for repair that is out in the market for less than 1 year.
we spent half a hour testing the camera, there was no problem, but since it seems to be a manufacture defect, I have no problem taking it back. I think that's what a responsible person would do.
@JAC.. wow, that is scary!, yes, it's him.
Well. what happened was that he showed up. pretending to be a buyer for a product I listed. Which is fine, I told him he should've just called me instead (which he never did)... He said he doesn't have the camera at the point, so I told him I'm willing to wait for him for half a hour to get the camera. Then he changed his story and said he took the bus here.. So I offer to drive him home.
And then he took out the camera. and when I said I will buy it back now. he said he will make a few phone calls first. Made me wait while he called his friends for 10 mins. and then told me that he will "contact me later"
I'm just confused what he wants.
He came and took picturees of my car. I can't say I'm not a little afraid.

Hi all, I am the buyer of the camera, and I wasn't trying to scam the OP off anything.
I refused to give back the camera because it would be a done and closed deal and he would just got away with it that I would never stand a chance of justice.
kingofwale sure left out of a lot of details here.
You have 20 feedback so you are not a scammer, I am a scammer with merely 8 feedback then, right? oh.. may be that's why you used Kijiji
In the first place he posted his camera ad on kijiji ( unlike his usual posting on RFD), said it was brand new, which wasn't the case and said he will send me the receipt once he found it. I didn't mind it as long as it was working but he distracted me at the moment while I was checking for the camera.( took the camera and changed it to 16:9 blah blah saying his gf took amazing picture in this mode )
Got home found out the problem (blue line in the middle of every picture, even in the one i took at the transaction, but the camera screen is too small it's hard too see) emailed him right away politely at 11:30pm about if he can find out the receipt so I can go in for a repair. (called sony the next day quoted $150 flat rate to fix)
No surprise I never got a reply from him via email. Remembering him mentioned he was going off to Nova Scotia and was a member in RFD(never mentioned his username though), so I started searching on google and luckily I found out a post of his for-sale that has cached in google
I was lucky to find a RFD forsale post with some trace of him from google cache
http://b4.s3.quickshareit.com/scam2b7f13.jpg
Here's his original RFD forsale post
http://b6.s3.quickshareit.com/fsquicksale_bnibipodtouch2ndgen16gb250redflagdeals jpg57350.jpg
Right after I emailed him at 11:30pm, he edited his post at 12:43am and deleted the "moving to nova scotia" part, right away I knew this kingofwale is the same person who sold me the defective camera on kijiji
http://b4.s3.quickshareit.com/scam3e3dc1.jpg
I purposely waited for him for 5 days to check his email before making any move or wrongfully accusing him, and no surprise there never was any reply from him. He told me his cell was canceled since his moving, somehow SMS still works that night and now he asked why I didn't call him? It was planned so well by him, that he can get away with it by simply ignoring any of my email(s)
http://b3.s3.quickshareit.com/gmailre_replytoyour_sonycybershotdsct9012comjpgf67 e7.jpg
I had to confirm and confront him using another account name, would he even bother answering me if i used "timmui" account? no way in hell. That is why I have to use a less suspicious username to pretend to be a buyer of his less popular battery sale. Because if I acquired about the ipod, it would be gone before I can even wait 5 days.
All the evidence is pointing out he knew the problem beforehand (which is very likely since camera sold for $350 +tax new at BB, $300 at blacks on sale now) , yeah call me stupid for not knowing "if it's too good to be true it is"
Most importantly, I NEVER said I want him to give me $150, i said Sony quoted me $150 for repairing. I will want $50 for repair because in the end I am only paying for $200 + $150 -$50 =$300 (retail price at blacks) so I am still happy i don't get ripped off badly and saved taxes.
And after all why wont I took the money and be done with it? I want my justice or $50 and not letting him get away with it so easily. So I was talking to friends today and asking around for advice.(btw, they told me there's nothing I can do, other than posting this and let everyone knows about it)
Once again, from the evidence he KNEW the camera was defective in the very first place and planned to sell to an unsuspected buyer:
1. by not selling on RFD like many other items he is selling/sold (ipod, ipod touch, battery.. etc) but instead on Kijiji to a stranger who can't leave you feedback
2. well below market good price (even he said it was new and it wasnt and he was such a nice guy it was so hard to reject him. He even tried to shake my hand today before I left, I was embarrassed)
3. Ignore a simple email asking if he can send me the receipt for repair and never gotten a reply for 5 days ( I can post the original email as requested)
Now, he never called or text me on my phone (he said he emailed me, but I don't really check it due to "Nigeria buyers" emails). I have 20+ positive feedbacks and definitely is not a scammer.
It's silly saying you want to avoid spam to not check your own email. What a lame excuse! The email I sent you has my name, and gmail stacks emails so that you would know you had communicated with that person before. After all how you read my first email wanting to buy your camera? and you deleted your Kijiji Ad anyways, although I have a copy of it (thanks to google again)
http://b4.s3.quickshareit.com/gmailinbox3187statisticgmailjpg98683.jpg
4. why edit the original post of your for-sale post that has the trace right after receiving my email, if he got nothing to hide? It would be a HUGE coincidence if he suddenly decided not to go to Nova Scotia at 1 in the morning, and edit nothing but that line in a for-sale post which is completely irrelevant to a sale.
5. at today's meet up first thing he asked was" how'd you find me?"
6. The biggest lie is he said " oh no problem, I will give you back the money and get sony to fix the camera with the receipt", hey I was asking for this receipt in the very first place so I can get it fixed at no cost and you ignored me. OK I am sure you have the receipt alright..
if anyone have any question for me i am free to answer it, and you can pm me for my phone number to talk with me as well.
I also had picture of him, but I wasnt planning to post it here, I wish other will do the same to me, and I think am the real victim. But who is the real scammer, I will let you guys to judge it.
PS: By the way, if i wasn't lucky and thank to google cache.. I could never get a hold on him. (met on kijiji, never told me his RFD username)
PS2: I love how he posted here first, he got caught then got scared so he bend the truth to make him looks like the victim, while I would be stuck with a defective camera if there's no google cache
PS3: I also love how before you posted here to accuse me, you did a few nice replies in Scammers forum for the first time to befriend with people.
PS4: Call me lucky again, but if I didn't saved all these screenshot proofs, I don't know how I can convince anyone that I am in the right given he went that far.

"And after all why wont I took the money and be done with it? I want my justice or $50 and not letting him get away with it so easily. So I was talking to friends today and asking around for advice."
@Tim
I feel that since it is an issue due to manufacture defect (according to you because I couldn't see anything) and since the purchase was recent and you aren't happy with the purchase, I'm willing to fully refund what you paid for and repair it myself. (and if you want it later, I will gladly sell it to you again).
But to scam me for $150, and now demanding 50 dollars is just unfair.
I'm sorry that I can't offer your version "justifice or $50". But I'm willing to fully refund your money if you are willing to meet up. If you want, we can meet up with another third party from this forum to ensure a fair trade.

when did i say I want $150 from you? let alone scamming you. I love how you keep lying to cover another lie. Tell me I said "hey bob, give me $150 or I will go to the police" in front of me.
But hey, say whatever you want because it's not the the first time you lie. You make it like there's nothing wrong happened, while if I am not getting a little luck here and there, and didn't give up too early I would never be able of finding you.
But to you i guess if someone stole money from the bank, got caught and was willing to give it back then he did nothing wrong, because he already give them back the money.
Man I feel like I was stupid trying to settle with you about the repairing fee ($50, the reason of this amount was explained in the previous post), for you to accuse me a scammer.
Lastly, I don't think I will keep arguing back and forth with you on the internet. Because I am sure it's all just a coincidence, and I am here to scam you but not the other way around. Say it a thousand times in your head, you will start believing it.. or may be you already did.
But you know what, I really learned my lesson today, and I think people here already know the truth.
A. If it's too good to be true then it is.
B. Never negotiate or settle with a scammer, or they will use it to go against you.
PS: but I am still open for any concern for members here, please pm me.

When you told me you were quoted $150 for repair and I better pay for it? Right before I told you I am willing to offer you refund.
I believe demanding money AFTER a transaction is completed is scamming (well, most people here do agree). If you aren't happy with the product, I am willing to give you 7 days from today to return it to me for a full-refund.
I believe it's more than fair.

You offered a full refund, he turned it down. I wouldn't even bother taking the camera back now knowing theres a chance the buyer could've done something to it.

I swear to god I never said that, but it's the internet with all this he said she said. I said I will take $50 to cover the partial repair fee and forget the whole thing of you scammed me. But this became what you are using to attack me and accusing me a scammer.
I love how you keep avoiding the facts that you knew the camera was defective(Why not sell it here on RFD in the first place? ) and how you tried to avoid me afterward by erasing your traces. Explain those to me.
It was me who gave you 5 days to reply an email (which I never got a reply, see my first post in this thread how I found him by luck), not you giving me 7 days return policy.
I am amazed though how good you can put this story together. You sold a completely good new camera but I found a problem, you were willing to refund me the money because you are nice and i turned it down, cuz I got this brilliant idea to scam you $150 and scared the hell outta you. Hey I may even got in trouble now that I "threatened" you like you made it out to be by took a pic of you and your plate.
Hey as I promised I will stop here now, it's afterall the internet you can say whatever you want and keep coming up tricks to attack me.
I am the not a detective nor am I the smartest, but I did my best by showing people all the clues rather than simply making up stories. If I am still declared to be the scammer then yeah you win, I lose.
But I know I am the one who is going to sleep well at night.
PS: to those that didn't read the whole thread, I am the allegedly accused Scammer :) and buyer of the camera, please read my reply inside this very same thread before accusing me, here:
http://www.redflagdeals.com/forums/showpost.php?p=8960090&postcount=13
PS2: A question for those that believe me, is there really nothing else that i could do like I was told, other than taking back the money and let him go on his merry way?

Tim:
1. You have just admitted to having multiple accounts.
2. You refused a full refund and tried to extort the seller into giving you money.
3. Your claims of wanting justice ring rather hollow in the face of the above.
4. Taking pictures of the OPs car is out of line.

My question is, why do you have two accounts, Tim?
If i recalled it right, back then you can thread crap on people's BST,
I did it to a few of guys for not knowing better.
I wanted to start selling and didn't want people to to the same to me =P
so i created an account to sell. But rarely use it, other than maybe if safari already has it logged it in one of my computer, I dont bother to logout and relogin, I use camino or firefox mainly.

I didn't refuse the refund, but rather don't want him to get away the crime quickly so i kept it and ask around my options.( proof on my hands, police, lawyer?)
I did say i will call him tomorrow (today) and hopefully he will pick up.
Taking picture of op car is out of line , and you post my img without first hearing my side of story?
And I was wondering what would you do if your were in my shoes? Did OP's intention of scamming people and pretend to be nice and offer to refund because of getting caught is encouraged? If i wasn't lucky I swear to god I could have NEVER found him.
it's the same as saying if you are giving back the money to the bank that you robbed after you got caught, then you shouldn't be punished?
by the way, OP left out what I said exactly, I was going for a settlement, i gave him an option of chipping in $50 for the repair and I will forget the whole thing or getting my money back, but I will let everybody knows about what's going on and keep my option to report it, But in order to report it, I need to have the defective camera in my hands in order to prove it, if it work that way (but seems no use).
PS: anyway, i am going to the police today and see what they say about if I am in the wrong and next time I would NEVER offer to settle with scammer if there's a next time, I don't care about the $200 anymore.

I would love to hear what the police will say about that, what's my crime? offering a full refund to a produce I sold while refusing to pay for "repairing fee" demanded by you??
And you claim Sony quoted you $150. Please show me the proof. I would love to personally talk to the guy who quoted you that. And frankly, demanding money this way is unethical to say the least.
I believe I have been more than reasonable in this case. If you want to continue to be a jerk about it, I will withdraw my offer of full refund.
If you do contact me. Please send me a text on my phone or PM me here, as I have told you before, I do want to miss the call and I want a record of it. So many things you have said above is far from the truth, I'm not taking any chances anymore with this.
