Seller sold fake dr dre in-ear headphones

I suppose this is partially my fault for not inquiring about the authenticity of the item...regardless, Seller Smithnwest sold me a pair of fake dr dre in ear tour headphones. When I asked for a refund he stopped replying to my messages. what should I do now? should I just keep the headphones and take the hit? is there anything else I can do? (paid through EMT, they arrived 2 days ago)

Not partially your fault. Knowingly selling counterfeits (whether stated or not) is typically illegal. You shouldn't have to ask a seller if something is fake or not, in order for it to not be fake.

My friend bought a pair of Dr. Dre headphones from Futureshop awhile back and later he found out it was fake. It wasn't a open box item also he later went back to notify the staff and got his money back... I don't know how but he did.

One of the email addresses comes back to a Michael V. Corleone (goes to OCAD, from Vancouver, looks Asian in the DP) the other comes back to a Jordan Crane (pictured with a BMX bike, not Asian).
