Better to Resign or get Laid Off?
Hey Guys,
I'm in a very interesting situation. I have a job offer I will sign on Monday and was planning on giving my 2 weeks notice the same day to my current employer. Interestingly enough, my current employer emailed me this morning to say that he will need to start my termination process on Monday seeing as a financing deal he was working on didn't go through for me to continue our current employment arrangement.
My question is. Should I give him my resignation letter on Monday or should I just let him terminate me? Some things to think about is that we had discussed this several months back that if he were to lay me off because of his lack of financing, I would get my 2 weeks notice along with my vacation pay etc. Am I still entitled to that if I were to resign? Is there a difference between resigning and getting laid off with regards to how much money I get etc?

If you get laid off, you'll probably get a bit of severence and your vacation paid off. If you resign you get nothing (maybe your accrued vacation).

Just wait ot get laid off, there's nothing that prohibits you from being employed in two places. See if you can get some sort of severance from the other place.

Laid off you get all benefits, resign you get nothing... No brainer

I've been down this path before, and I'd take getting laid off any day of the week.

I would take the unemployed route for the ROE form as you are quitting when you resign so your hours are not eligibale for EI if you ever need to go on it.
WIth lay off as well you get all $ owed to you vacation, etc....

I would have to agree with most of what has been said.
Being laid off is better especially considering the reasons for dismissal (ie. lack of work).
This way even though you are being laid-off you will still be able to get a positive referral out of the process.
I think this one is Win-Win for you!

Thanks for your help everyone! Looks like the general consensus is for me to let him lay me off come monday. I'll respond to his email saying I can't accept his 'other' arrangement and that if it means he needs to lay me off then it's probably the best thing to do for now.

As someone else mentioned, if this new job doesn't end up working out for whatever reason, a lay-off ROE from your current employer will make you eligible for EI benefits.

defin lay off. That being said, even if you quit, you still get you vacation pay. everyone is entitled to 4% accrued or paid out each pay check, at least in BC
