Bounced check but not really

We wrote a check a few months ago. We bank at CIBC. The check was deposited into RBC and sent back void, due to insufficient funds.

Only, we always had more than enough to cover the check in our account. Our banker said it never actually hit our bank account - that we would see record of a check that went through our account whether it bounced or not. We confirmed all of the info on the check was correct (name, date, etc).

The person we paid the check to is trying to get us to pay a $40 fee charged to him by his bank but we are refusing because the check didn’t actually bounce. It was a problem with the clearing company or something. His bank says it bounced, our bank says it didn’t.

Where would you go from here?

I would tell him that according to a trace from your end, the cheque was never presented to your bank. So unless he has proof of something else, you won't be paying the fee.

Ask to see a copy of the cheque AND the envelope it was returned in. The envelope will indicate the reason the cheque was returned.
