its not bait-and-switch, i think you need to look up definition of B&S
bestbuy sells the BB exclusive models
which does have 3 cell
BB.ca does NOT carry the BB exclusive 6 cell model yet so they are not trying to upsell you by pulling a B&S
non-big-box retailers and such sell the P and M models which has better CPU and such

1005HA design is old but for Win 7 SKUs, specs are new
more HDD, webstorage, and a few other changes
take 1008HA for example
for 1008HA-PU17 (win 7), it comes with win 7 home premium, 2GB ram, 320GB HDD, 500GB ASUS WebStorage
1008HA-MU17 comes with win 7 starter, 1GB ram, 250GB HDD, 500GB WebStorage
old XP SKU all only had 1GB memory, 160GB HDD... etc

Not sure it is necessarily bait-and-switch in this case, but definitely false advertising. They advertised the up to 8.5 hours of battery life on the flyer (even the tags printed out in the store say this) but when purchasing it, they were selling only the 3 cell model with 4 hours of battery life. Made lots of people angry yesterday after lining up for it, and that was why they still had tons hours after opening.
I think more people brought the Gateway after figuring out this was a 3 cell battery.
