Can Sublet Tenant Stay Past Lease Term?

If we are sub leasing out our apartment for two months while away on vacation, can the tenant refuse to leave at the end of the two month term? There is a written agreement and we have permission from the superintendent.

If the tenant does not want to leave, how long does it usually take to get them out legally? Thanks.

Seems like you’d have to apply for an order of eviction, same as a landlord would to evict a tenant. How long it takes to get them out would depend on how much the sub tenant fights it, and court schedules.
