Did I Get Ripped Off? Help Decide Whats Fair
Ok im gonna tell u all a sotry and i just want ur input on whats fair, cuz obviously i have a bias and so does my seller, also i wont name him/her but he/she can read this and we will make a desicion based upon that.(even though u might be able to guess)
I lusted afer a k750 i for a very long time and finally found one at the price 370. The seller agreed to flash to the w800i firmware for no cost, and i paid shilling (9$) So i get the phone and am excited use it for like 4 hrs calling and taking pictures but then i turn it off ans swtich to my old phone so i can get the pictures and junk off of it and get it ready to sell. I never had the phone on for mor then 6 hrs untill the night of the second day or first (i dont remeber but i can get a time if this is vital) and i leave it on over night and find the phone frozen. As you may giess i was freaked out so i took the bat out as i had to (turning it off wouldnt work or nething) and i reasearched and i found it to be an old firmware problem, but the firware he/she put on was new. This problem gets more and more ever 2 hrs, 1 hr, 30 mins, 5 minz. I ask the seller for the code so i can try a master reset...same problem thing happens.
So i emailed the seller and he/she said i could send it back and re flash it, although he thought it was wierd cuz they had tested it for a bit. So i shipped it back at my own expense and he tells me that the w800i firmware wont work on it, it starts freezing but he/she can load the k750i firmware unless i sumhow lock the keys alll the time b4 using it. I give in because i wanted the phone so bad , so he/she ships it back, and the day i get it back i pop in my sim card and guess what? same thing happens again.
I obviously im annoyed at the phone, and i have asked this seller for a refund...360 and i pay shipping. BUt the seller is argueing that i somehow broke it and he/she would buy it back for 320 shipped by me. This would give me a net loss of 370-320 = 50 + 20 for shipping it twice , so 70 dollers. The seller says that this is a loss to the seller if he/she abought it back, even though it apparently worked 24 hrs when the seller had it to reflash. What should i do? what do u think is fair? any help would be apreciated.
i think that i should get an at least close to refund as the phone came to me buggy, but i want the input of the readers

Here is what I would do first,
1) Go the sony ericsson website and do a recovery of your phone. As long as you have the USB cable for the phone (which you should), you should be able to attempt the recovery. For more info on doing the recovery, go to howardforums. Its a pretty self explanatory process.
2) If that doesn't work, I would go to davinci team's website and flash the phone yourself. Its super easy to do and it only costs $10 US to flash to any firmware you want for your phone (k750 or w800). Again, all you need is the USB cable.
If its just the firmware problem, I wouldn't bother sending it back, as I am pretty sure you can fix it yourself. Worse comes to worse, find another person to flash your phone for you.

The thing is he reflashed it, and also used the davinci stuff, also the cable didnt come with it

All bets are off when people flash things. He said he would flash it for you for free, just because it is free that does not mean you should have accepted his offer. You should have just purchased the phone in it's original state. I think you should either get the phone flashed by someone else or return it back to seller and take the hit.

but when u buy stuff u assume its in working order dont you? and the seller has doen this many many times so i didnt think ne thing of it

Unfortunately, I would need to side with the seller on this..
yes, he sold you a defective phone, but it sounds like when it was in his possession it was working fine....it was only after it was flashed that it started acting up...the flashing was requested by you, so any repurcussions should be handled by you...
I hate to say this, but the fact that the seller tried to fix this problem for you and now he's offering you any type of refund is really a bonus..i know some sellers who would've blown you off by now...
anyhow, my two cents...sorry if it isn't what you want to hear...

no thats ur opinion, but im convinced it came to me with bugs in it already
cuz i didnt have it on for over 6 hrs. so it was prolly buggy before i got it

also i was freaked and read its a firmware issuee...countless forums i read. and im pretty sure the phone was already flashed cuz he convinced me to keep it that way

where are you located? I'm willing to take a look at it for you... whos's the seller?
firmware flashing can go wrong sometimes.. but depending on the skill level of the flasher some may be better at trouble shooting...
the seller has offered you and out.. so he's being fair.. shipping losses aren't anybody's fault..

i'm not saying it doens't matter... but you can't really cry about it.. the seller is spending "time" fixing it too...
anyway i'm in oakville, and i'm willing to take a look at it... just need to know the exact problems..
might even be a sim card issue....
white screen?
freezing?
rebooting?
etc..etc..

i got it bugged thats the problemm....i got it bugged and no i didnt do ne thing to it u dont haf to believe mee but i know i didnt. The thing is it came bugged, so thats why im mad, all i did was a reset nothing more nothing less, made some calls ( prolly like 10) then it froze. Its like selling a tv that freezez after 6 hrs of watching but i turned it off at like 5 for two days so i didnt realize it. I know its not gaurnteed working, but like he says he had it "working " apprently and i offred him it back at a discount.. so hed be up 20$ with the same fone, and if it appaerntly works for him then thats a good deal is it not?

He can corborate most of the facts...like most are facts...if i dropped its my fault and u dont know me...but lets assume that im telling the truth. Because its in perfect condition otherwise.

I have decided to keep the phone and try and fix it...i agree i cant keep bitchin about it but...loosing money and having a practically dead phone sucks big time. Especially since ive wanted it for soo long. any ways the selller is still a good guy...i just think that in this instance it was unfair. Now im asking who can help me fix the phone? It freezez when its on standyby ever 5 mins, and also when it says insert the SIM. The menu is also super laggy. When i turn it on it has a white screen for a long long time then vibrates. I think the newestk750i firmware is on it.
