hi there, im trying to get out of my rogers cell contract without paying the 400$ penalty. I understand there is this thing called the Material Adverse Clause which basically allows you to get outta your contract for free if they make changes after you've signed it. Some people have told me i can use the HST to enact the clause. I also was forced to downgrade from the 6gb data package that i originally signed the contract with to a 1gb data because rogers discontinued the old package...they told me i cant use this to enact the clause but i think its BS....anyways ive threatened with a PR war via social media so I think they may just allow me to leave but if anyone knows an easier, less destructive means to get out, id love to know. thanks

Rogers did not discontinue the 6gb data plan, that was probably a tactic to get you to switch for some reason. The MAC is just that, it requires a MATERIAL change. Paying 5% more is not that material, since EVERYONE regardless of cellphone carrier will be paying that extra 5%. As far as I know, the only time the MAC works, is when they made the Local Calling Area's smaller, which was a fundamental change. when you get them on the phone threaten that you will hold your breath until you get what you want, and do it don't just bluff. and even if they don't we all still win._______________

It was always known that the 6GB plan was for a limited time only. Once you got the plan you were locked into a contract and they cannot downgrade you. Seems like you were fooled by some CSR and you fell for it.

My friend still has the 6gb plan, so you must have been ripped off or tricked.
Here's an answer you can use: See if they'll let you quit because of their tricking you out of 6gb, and if they can't then tell them you're willing to keep being their customer if they'll give you back the 6gb plan and/or some other features.
Then, once your plan is appealing (good bang for the buck or a discontinued option) you can post it here or HoFo or somewhere and someone else will probably scoop it up from you. Then you just transfer it over and you save $400 or whatever.

One other thing you could do is see if they'll put you on a minimal or $0 plan. Say you're going on vacation for 3 months or something. If they do, then just let the plan run itself out once it costs you nothing._______________

If it were that easy, everyone would be canceling their contract for free. When I originally signed up with Rogers, I went under a company plan. I signed a contract that the salesperson laid out after talking on the phone with whoever on the other end. Turns out, that doesn't mean anything. Luckily, I was willing to stay with Rogers after the whole fiasco, and eventually negotiated my contract to something reasonable. It would help if you would state why you want to cancel your contract.

Sad to say but yes.
The 6gb was not removed from the system, it was merely deactivated for addition to new account. It is now in grand-fathered status.
In fact. If you *really* want it back., raise a ticket, and they will add it back on for you. Takes time, or just knowing the correct (and most efficient) route to take.
