That's not necessarily true. Depends on the situation. If he is on your property and you beat the crap out of him then it is legal because he is traspassing on private property and you have the right to defend your property. It does not matter if he is on your yard or in your house it is not legal to beat him.And you will face charges.There have been a few cases over the past year year where people were getting robbed and the owners went to try and stop these people and guess what they got more jail time then the people who broke in.
