I think he will just be sued for starters to reclaim the repair costs and possible more?...I am sure he can still be charged, he will never be able to prove he had insurance or bring it into question as to if he may have. The persons car who he hit should file a police report that will get the process started. Your buddy is screwed in my opinion. Did he contact the victim?
Whos car was it? Are you sure the car was not insured?

Insurance
ok im buddy of mine got in a car accident last week, it was was raining earlier on and it froze, as he was coming back from wat ever he was doing, he found him self stomping on the breaks, but no luck, he hit a parked car. Now heres the twist, he has no insurance and has a alberta GDL class 7 liecence. AND most importantly, the police never showed up. If the police never showed up and never gave my buddy a ticket then, he cant be charged with no insurance nor a proper liecence, correct ???

Was it a hit and run or did the police just not come to the scene? If the car owner reports it to their insurer (and I hope they know who hit them and it wasn't a hit and run) it won't take long for the insurer to determine that the driver of the at fault vehicle had no insurance.
I certainly hope he gets everything he should. A $5,000 ticket for driving without insurance is nothing. I have no respect for anyone so selfish and stupid to drive without insurance. He's lucky he only hit a parked car and I would think he's not going to have any easy time getting insurance in the future.
ETA: Just because the police didn't show up and lay a charge at the scene, certainly doesn't mean he can't be charged. Charges under the Highway Traffic Act have to be laid within 6 months. However, charges under the Compulsory Automobile Act (driving without insurance is one of them) have to be laid within 3 YEARS.Last edited by sillysimms; Dec 6th, 2008 at 12:18 AM.
