if you'rea guy that has no intentions of doing any OCing or high end gaming the PCV deal is better

Having been a tech at a computer shop for a few years now, I've RMA'd many many Intel CPU's without any problem.
The only time Intel will refuse an RMA is when it is physically cooked. Most overclockers won't actually fry a chip, but the gradual decrease in the chips life from running 1-2GHz faster than intended will cut the life significantly, at which point Intel will RMA the chip.

Q9450 is scheduled to be phased out in Q3 ...
Q9550 will take over its spot ... The half-cache (6MB) version Q9400 will also show up at the same time ...
