laidoff and my job is reposted???
I just got laidoff as part of a restructure. but, i found the same position, same title, same group, same qualifications etc on the same they i was terminated!
is it allowed?
I did get a semi decent package.

I did get a semi decent package.
I am not familiar with the laws, but I am fairly sure that it is actually NOT allowed.
I heard something similar on the Radio a few weeks ago.
Bell laid off some CSRs.
Bell reposted some jobs
One former CSR lady was very upset.
Lawyer got involved.
etc.. (I don't remember the rest)
With all that being said.. Were you at the company for a long time? Was it only you that was laid off? Is it easy for you to find a similar paying job?

I don't understand what the issue is. They fired you without cause so they gave you payment in lieu of notice and now they are trying to find someone else for the job. What exactly do you think is illegal about it?

i thought it was Not allowed. i am looking through the ontario labour laws and the ESA.

They laid you off without cause, and gave you a fat severance package. and they want to hire someone else. there is nothing wrong with it. maybe if you were better at your job, this wouldn't have happened.

If it's a regular lay off then no recourse because of the nice severance (I think minimum is 1 week per every year of service and companies usually give more to avoid law suits based on economic hardship/tenure/notice of termination, etc.), but OP said "restructure". If you were to have a chance at anything, you better have documentation on this restructuring.

Why would anyone want to do business in canada if it's so hard to fire people. Ridiculous, if it's this hard to fire people, just wonder how difficult it is for somebody to hire someone knowing if they try and get rid of them they will be looking at a disgruntled ex-employee finding a way to sue. No wonder everything is being done in China now-a-days, big fat cat monkey grubbing businessmen don't have to deal with this bull over there and we wonder why there are no jobs in Canada.

I believe you are thinking of "recall rights", which are discussed on this page. As far as I know, there is no automatic right to be recalled to work, it is simply a clause in many union contracts. Even if you did have it, the agreement you signed to get the severance package would have made you give up that right.

Seems like they fired you in the nicest way possible. Now that you are layed off instead of fired you can get EI. And looks better than firing when you go apply for your next job. And they gave you a severance package too. Would you rather have had them just fire you instead?

and what makes you think i did not do my job? over the last 4 years, i achieved 136% above my targets, always ranked 1 or 2 in my team.

It's not always about targets. Perhaps they fired you to find someone who's a better fit for the company. Less attitude, more participation, etc. Or maybe because you've been over your targets and feel obligated for a higher raise when they really don't want to give you said raise. It sounds like they had wanted to fire you but laid you off nicely instead.
The point is, they fired you, gave you a decent package which you had signed for. Now they are free to hire another person to replace you.

agreed it is always not about the targets.
I do agree that I did not see eye to eye with my manager. neither did the rest of the team. example: i have a son who is going through autism testing and requires time off since it is with OT, PT, ST and specialists. ST alone is every 2 weeks for 2 hrs. PT is every 6 weeks for 2 hrs. OT is every 6 weeks for 2 hrs. He mentioned to me about my time off and my lack of dedication to towards my work because of this. I gently reminded him that i did book these in advance. i guess it could have been over my dedication to my work if that is what is means.
the bright side: i do get to spend more quality time with my older son who is now officially diagnosed with autism. I got laid off 12 hrs i got the official word that he is moderately-severely autistic.
