Here is what went down yesterday i was at a zellers and some wise guy punched me in the back.It was not all that hard but i have a bad back as it is and this punch did not help at all.The thing that got me is i fell down as i got up he is looking right at me with a little smile.Does any know if legal action can be taken in a case like this.

I'd file a police report about this. Make sure you tell the police that you will gladly testify. Nothing much will happen to the guy, probably just a fine.

Was the punch provoked? And what was your response? You need to tell more info than that to determine whether legal action is possible, and given that, you should talk to a lawyer if you think you have a case.

It doesn't matter whether it was provoked or not. Report it to the police. If they can track the guy down (do you know his name?), then they will charge him with assault. It's a criminal offence and will result in more than just a fine.
Don't waste your time and money speaking with a lawyer, that's just dumb! You do not need a lawyer, the police will take care of everything for you. File a report and the police will arrest the guy._______________

I really do not want to talk to a lawer about this.This guy is known for this type of stuff.No it was not provoked at all i was just looking at the movies and walks by and punches me.Once i did get up he gave a smile.I really did not say anything.

I'm sorry to hear you got punched but...you were just standing and a guy punched you in the back?? picturing something like this makes me laugh.
although you should report it and I hope they catch the bastard.

You do NOT need to speak with a lawyer. That will do you absolutely no good in this case. I can't believe someone even suggested that. It just goes to show that you shoudn't come to a site filled with 16 year olds and ask important questions.
Go the police station (don't call them, this isn't an emergency of any kind), file a report. Provided there's no reason not to believe you, they'll likely go arrest the guy within hours of you filing the report. They'll also go to the store and get a copy of the surveillance tapes that recorded the incident (if applicable). If it's on tape, this will be the end of your involvement. The guy will have no choice but to plead guilty and you wont' be forced to testify. If it's not on tape, you may have to testify in court on a future date, although it's very likely the guy will just plead guilty since it's not a serious offence.
As for what will happen to the guy. He'll likely be released on an undertaking forbidding him to have any contact with you, keep the peace, stay away from drugs and alcohol, etc. It's basically a restraining order, but you don't have to get it yourself, the police will do it for you.
I suggest going to file that report ASAP though. The longer you wait, the more your credibility will be hurt._______________

well technically I think the puncher is legally absolved of any liability if he mentions the phase "punch buggy" immediately prior to the punch. precedents have been set. maybe that's why he was smiling?

He is alwas in some sort of trouble.I do know he is about 21 and lives at home with his parents.I do not know him but i do know where he lives.Due to this i have to have more treatment done on my back i am thiking of talking to his parents and say if they pay for the treatment i will not go the legal route.

Trust me a fine is all the guy will get. I had my faced smashed in by a guy when I was young. He wasn't a young offender and had a criminal record and the judge gave him a $1000 fine. He even got to negotiate how he would pay said fine. Still worthwhile reporting however.LOG IN TO THANK No one has yet thanked dealguy2 for this post.
