Do these discs share the same media code as the rest ?

Maxell DVD-R's 9/50 are messed up in the spindle from FS
I'm using a Benq 1620 fwB7V9.
Most of the dics are fine and allow me to burn max of 12x. But I have run into 9 of them (may have more) that show up in nero as max 2.4x and when I try to burn it at that speed it fails.
Maybe a bad batch? Can I return this to FS even though it's opened?

yes u can
i return a 50 spindle of benq dvd+r, i kept 11 that burnt fine, they gave me back my money for 39discs worth (which were a mixture of coasters/unused)
