Because nobody paid the law firm to provide their legal opinion before.
In the end, this likely was not legal, but it wont make much of a difference.
People in council are slowly admitting that the Transit City plan was actually the right way to go. The new proposal from the chair of the TTC is looking a hell of a lot like a crappier version of Transit City. They are realizing how much sense above ground rapid transit makes, by proposing the have parts of the LRT above ground again, and putting in a busway or LRT along Finch.
The utter retardedness of the Sheppard subway extension is that in this plan, a full 1/4 of it is going to extending that subway like 1km through a very low density residential/commercial area. There is 0 need for this. It is really just pissing away our transit dollars.

And how many millions did he waste cancelling Transit City? And he is squandering all of his resources nickel and diming the garbage workers? Unfreaking believable!

Transit City was a waste of money to begin with. Everything should be underground in this era. What city in this world is still building streetcars/lightrail? At least Rob Ford has the right idea, to work on subways and not these stupid streetcars/lightrails.

reading anything about Ford posted on thestar.com is questionable, it's always going to be 100% bash Ford.
Even though many may not like Ford, he wants to make sure public transit is underground and not messing with cars. Not burying the eglinton LRT 100% is very short sighted. Eglinton is always going to be a busy street, why do we want to stick street cars in the middle of it? With streetcars/lrts you get the associated annoying "U-Turn Signal" "Protected Left Signal" and make it a real PITA to turn or visit any of the plazas that are abundant in the east side of eglinton.
As someone who drives in this city, I can appreciate Ford's stubborness about dedicated streetcar/bus lanes.
Frankly I'd rather see more dedicated bus lanes be installed in hydro corridors.
The money saved from not burying eglinton could extend the sheppard line a whopping 1 station. Yeah Sheppard / VP is a really important intersection. Now kids can go to chucky cheese by subway...

Here's wiki's list of tram/light rail lines in existence or under construction. You'll notice there are a fairly large number under construction.

If you scroll down to the Canada section, they are all either under construction or just a proposal.
