My friend's wife got a bad unit (from Tuesday) and went to Fairview last night to exchange it at the Apple store and it came with 4.0.2. It wasn't new in box but came from a smaller box like how the 3G/3GS warranty swaps. He asked if it was refurb and the store said the phone is still new so they don't have refurb units yet.

Dev team has pretty much stated they won`t JB 4.0.2, so your SOL until 4.1 is released then jailbroken.
