Rock Band 2 89.99 at Sony Store Lundy's Lane Niagara
Just bought the Special Edition (one axe, one drum, mic, and game disc) game two days ago (I was on vacation so excuse the late post).
There were still 3 boxes left. I asked the store clerk if they were previously opened boxes since the boxes showed a few wear and tear on the edges, and he said they were shipped from another store (probably unmoved stock).
I have yet to connect the peripherals on my console (I am still unpacking from vacation) but I have inspected the items at my hotel at Niagara and all items in the box seemed untouched, and had the bubble wraps and carboard protectors not showing any tampering.
Of note, GH:WT was on sale also in pristine boxes at 99.99. But IMHO, RB2 is better.
I will post again once I get the game going.

So this must mean the Rock Band 2 SE is for PS3 and not XBOX360.

I was at the store this past weekend too. I didn't see the RB2, but saw a ton of refurbs so I would think the RB2 is as well. I guess if you're interested, you can always phone first, before making the hour drive. They had refurbed PS2 slims for $70 and clock radios for $12. Way overpriced IMHO.

Correct.
Agree. The gameplay is so much more in RB2 sp. with the wealth of DLC. Besides, the peripherals aren't that bad. Not as good as GH:WT but good enough to make the gameplay enjoyable.
Update: Played the game. All items except the box (lol) were pristine. Rock on!

I think Andrews21 is right. No retailer usually accepts Musical instruments game peripherals for returns. They'd ask you to contact the publisher; i.e. EA or Activision to replace the item, so save yourself the trip.
It is unfortunate, but you will get a replacement with enough patience.
