I've sold many phones and other items and boughten many items and phones without a problem. This guy is being a nut job for god knows what reason. No where in the post do I offer a Sim Card. When he first called he wanted me to drop the price to $60 and I refused, I said I'd consider $70 but I wasn't going to sell it for $70 and that I wanted $80. He again said $70 and I reiterated what I said. He kept asking about the "newness" of the phone and to "make sure" I was there at the meet, as though I would miss an opportunity to sell a phone that I offered and made the arrangement to meet for. The day of I get a call an hour earlier asking me to meet up with him right then because he wanted to watch a movie, I was at the gym and had informed him of a tight schedule over the phone in which I had reiterated the time, price, day and location of the meet several times. We meet outside of the Tim Hortons we arranged for, 15 minutes later than he had said, and instead of going instead he stood outside with his girlfriend under the light and inspected the phone. Now here's the kicker, he keeps saying the charger was the wrong charger but when we had the conversation outside of the Timmys he was talking about another motorola charger he had at home that was from an older model, and I had told him it wouldn't work on this one because it was a mini-USB charger, to which he then checked to make sure, and again questioned the newness of the phone. He spent at least 5 minutes inspecting the phone and another 5 questioning me about it before finally handing me the $80 and joked it was $60. Everything seemed to be fine, until two days later when he called me up and told me the phones charger was wrong and that he had gone to the store and found out it was '$30' and that I should "pitch in" and give $20. Now why would he ask for $20 instead of $15? He originally wanted the drop in price to $60, the way he went about outside the Tim Hortons even after I had offered to go inside that way he could inspect the phone and contents properly and the time in which he called me afterwards all make me suspicious of his activities. He says I sold him a "used" phone because it doesn't have the manual or sim card. I didn't offer either in the post. I offered a BNIB phone, not the contents of it. I gave him the proper charger, battery and all of that which was inside. Except for the sim, which I took out, the return to your old phone to rogers packaging thing I took out, I don't recall anything about a manual when he was inspecting the phone. So he's just busting my balls over $20. Is this honestly what I'm gonna have to deal with selling phones? I've never had a problem on TWO sites and on ebay. So I really don't know._______________

+1 as well about being credible...
but what i dont get from ppl around here is this...
why use the term BNIB (brand new in box) if the box has been opened to take out something like a sim-card... or like an unwrapped game that hasnt been used.. if its not sealed or actually BRAND SPANKING NEW in the box (for items that are not sealed) then its not brand new in box.. if you open it up to take out a sim card.. and no manual.. then its LNIB...just a thought.. i also have gotten kind of scammed with a BNIB item that wasnt what it was.. though that is hopefully going to get rectified soon

It is BNIB, it just wasn't sealed. For some reason even when I got the phone from rogers it wasn't sealed. Maybe it's a motorola thing? I'm not to sure because the box itself was only closed like you'd find a regular box. And just to make sure it's necessary to check everything inside of it. So seal's sometimes have to be broken and what not.

1. At this point and time, the buyer has acknowledge that the unit is already opened, not sealed. (since he is inspecting the unit in hand).
2. He inspected the phone, asked questions, etc. and was satisfied with the contents of the box. which is why he handed over the money.
Buyer is at fault for not confirming the contents of the box if he was unsatisfied at the moment of purchase._______________

hey
i actually trusted the person statement that he posted on redflagdeals as BNIB cell phone...
I dont know anything about cell phones to be honest and opened the box just to check if charger was in there and phone too ...These are the two main things that came to my mind that should be in the box....
Turned out that the Charger was the wrong one, instruction manual wasnt there either and sim card too wasnt there!!! He took out the sim soo he can make an extra 10$ on redflag deals..... here's the link of him selling the sim card : http://www.redflagdeals.com/forums/s...d.php?t=653602
