Seatbelt Question

Me and a buddy were in a friends car today and as we were getting ready to leave the driver said to our friend that he's not starting this car until he puts his seatbelt on. To make a long story short, the drivers reason (besides safety) was that there is some new "No Tolerance" traffic law that states if anyone in the vehicle doesn't have their seatbelt on then the driver gets the fine/dermit points. Something about safe operation of a vehicle and being personally responsible for these people.
We are all 23+ and all of us have our G licenses. I said that since we're over 16 it doesn't matter.
Just curious for my own interests if this is actually the case?

I can't always see what the people behind me are doing and if I got a ticket because someone took their belt off, I'd be pissed!

Because here http://www.torontotraffictickets.com/seatbelt.html it says "The driver is responsible to ensure all passengers under 16 years of age are properly restrained. If a child is under 23kg (50lbs) he/she must occupy a seat fitted with a seat belt when available."

No you're wrong, like Arkaine pointed out the driver is only resposible for those under 16 those over 16 are on their own.

16+ passenger gets the ticket. -16 the drive is responsible for the passenger. In the state of Massechuchets (of however its spelled) you don't need to wear your seatbelt, a cop cannot pull you over to give you a ticket for not wearing a belt however, if they pull you over for like speeding then they can give you a ticket for not wearing the belt.
Anyways the driver of the vehicle is actually right not to start the car without every one being belted up. My mom won't let me even move the car 1 inch unless my 2 sisters, her and I are belted up and I own the car and drive it (she doesn't drive). Its just safety and common sense.

If anyone cares, I stopped 2 cops this week and asked my cop friend this question and they all said what IoannI said above. 16+ their own fault, 16- drivers fault.

I believe it has to be in the jurisdiction on where you were caught/charged.

Oh I have no idea man.
If you have a clean history, can partially explain why you weren't wearing it (not sure what can be said there) and you can show some sign of remorse they may drop it. I have no clue to be honest.

just tell them its more comfortable to wear one. seems like ur friends dont drive a lot because if they do, they'll actually feel more comfortable wearing one than without one

The driver is responsible for anyone under 16, as mentioned, and is also responsible for having enough seatbelts for the passengers

That means even though all the passengers are 16+, you still have to have enough seatbelts for them. 4 seatbelts and 5 passengers = illegal, regardless of age.

Even if they say it feels too restrictive, I mention that plastic tubes coming from your body would be a little more restrictive!

Anyone who argues they don't need to wear a seatbelt has either no common sense or has never taken a physics class.

What do you think happens to a human body if its travelling in a vehicle at 100km/hr and comes to a sudden slamming stop. Obviously the human body keeps moving at the original rate of speed. Good luck trying to find something to hang onto when you're flying out the windshield.
