Small Claims - File by Mail?
I have a claim filed in Small Claims Court, but cannot easily get to the court to file an Affidavit of Service, and have a Notice of Motion which I need to file.
Can I mail them in?
If so, what needs to be included?
_ Form (2 copies of Affidavit of Service, one for them, one to be sent back to me) (3 copies of Notice of Motion, one for them, two sent back to me - I serve one on the defendant)
_ Payment (Cheque, Certified Cheque?)
_ Self-Addressed Stamped Envelope?

I don't believe you can mail them directly to the court house. What city do the papers need to be filied in? Get a process server to file them.

I'm in Mississauga, the court is in Brampton. It's only 2 buses to get there, but it's annoying to have to go to Brampton.
Canada's sixth largest city should have it's own small claims court, or even a filing office, hell even Oakville has an office to file forms, but not an actual small claims court.
I would have assumed that they could be mailed in because the clerk was sorting forms and cheques from Lawyers when waiting for me to fill out the post-judgment costs and final total on my writ of seizure and sale filed today.

Milton has one to. The wife was in Brampton court today and waited 2 1/2 hours, that was for superior court filing though. There is usually very little wait time for small claims court in Brampton.

I average a 1 hour wait in brampton for small claims, once was 45 minutes and today 1 hour 15 :P

Wow from the last time I filed something there it was in and out for small claims.
