or you could do the blatantly obvious and call your insurance company.

Someone's tree fell into my backyard
So during the storm, a tree from someone else's property fell into my backyard. There isn't too much damage on my end but what would be the proper procedure for something like this?

We just had this happen on our street. Big tree fell and destroyed the neighbour's pool (B) from the other side of the fence (A).
As a note, neighbour (A) is not responsible for anything on B's property according to both parties insurances. This meant that B better of had sufficient insurance and a policy that would cover a falling tree. Add to that, B had to be there and arrange to have the tree removed (ended up costing more than a thousand).

Same thing just happened to my sister. A tree located on her neighbors property collapsed on my sister's garage. The neighbor paid for damage and cleanup.
Also, if the facts show that the tree has not been maintained (trimmed), negligence could be claimed.
Personally, if it was my tree on my property, it seems to make sense I would be responsible for its "'actions".

You are a very good neighbour. Where do you live ??

One of my neighbour basically ignore all the trees that is in their own backyard. The neighbours on all sides, including us are very frustrated. They said they did not plant it and we can cut them. They even slam the door to one of the elderly neighbours who complain about the trees.
What can we do ? Has anyone been succesful in claiming negligence about the neighbour who neglect the trees ? I live in the city of Toronto.

You have no recourse against your neighbour unless you have notified them in writing several times that their tree poses a liability (ie dead limbs). If they have an Arborists' report that it is healthy then it goes to court.
No insurance company that I am aware of will cover damage to another property.
