Subletting Help
me and my friends decided to sublet our rental house for the summer and the tenants (from ireland and will be returning back in 4 days) has caused some damages to the house which our landlord provided a bill for 300+ dollars. the tenants refuse to pay, but we have a 400 dollar cash deposit on our own furniture and a post dated cheque for 1000 for the 31st of this month. our problem right now is that they can stop payment on the cheque and just leave the country and we're stuck with the damage payments. Some of our furniture is ruined so we dont want to use the cash deposit for that yet..is there any legal way to solve this before they leave the country or are we basically screwed. It's stated in their lease that they have to pay for damages incurred by them and such but thees nothing stopping them from not paying and just running away ....thanks in advance

Subletting isn't illegal, but most leases provide that subletting can only occur with a landlord's approval, otherwise the tenant will be deemed to have breached the lease. Ultimately, the tenant (ie. you) will be responsible for any damage caused and you may be on the hook if you can't get the money from the subtenants before they leave the country.

not sure if this will help you but you should be able to bring the cheque they gave you for 1000 to the bank that it is witten from, if possible not sure where there branch is located and ask for a money order. my grandma has brought cheques before to the branch the person who wrote the cheque deals with and for a fee gotten a money order, which is like cash.
