Ticket on the 403 - 49 over. Ticket missing info...

Ticket on the 403 - 49 over. Ticket missing info...

My friend got a ticket in a 100 zone going 49 over last week and she needs some advice.

The ticket does NOT indicate by how much she was speeding, the officer just told her that he clocked her at 149, it also doesn't include how many points it will cost her.

She would like to fight the ticket in court but she's not sure what she should plead. Also, is there any chance of the ticket being thrown out since it's missing info? All it says is the amount owing-- ($350).

Tickets won't show how many points it cost you. The info is speeding, at how many KM/hr over and the fine.

take it to court!!!

If the ticket does not say something like speeding 149 in a posted 100 km/h zone or if they left it blank, they will throw out the ticket since it would be considered a fatal error.

If the ticket says she got clocked at 149kmh on Hwy403... then it's pretty much given she was doing at least 49 over because the highest posted limit is 100.

The officer was being nice and saying she was 49 over. I bet you the officer probably clocked higher and didn't want to charge your friend with street racing.
Evolution has evolved so much, it doesn't exist anymore.

Is it per your own experience that your ticket got thrown out or you just read the information from that site?

That is a common police officer scam. They will lie and say some really high number in hopes that you'll admit that you were a smaller amount over the speed limit. ("But officer, I was barely doing 130!!") They will write all of this down and laugh all the way to the bank.

I'm thinking she got lucky.

I would probably pay the $350, knowing that the OPP gave her a huge break, if she was doing more than 50km.

You might be onto something, after all, the cops get kickback from each ticket the write... :|

Whether a cop writes a ticket for 10 over or 150 over doesn't make a difference to that officer, a ticket is a ticket.

Do not pay the $350.

If you think you will lose - at the very least, go to court and meet with the prosecutor BEFORE the trial. Instead of a 30 to 49 with 4 demerit points, you can agree to enter a guilty plea for 16 to 29 with 3 demerit points. IF you have a solid case and a clean record, they may even bump it down to 0 to 15 with no demerit points.

The cop is after a conviction, and if they can get the person to incriminate themselves, the cop's life has just gotten much easier.

The "laughing all the way to the bank" line was more of a reflection of the operation of the government in general (and the cop's role as a public representative,) as opposed to the cop's personal motivations.

If she was really going more than 50 over and the cop felt for her and lowered it to 49 over, you'd bet the cop would remember this incident and definitely show up.
