ticket for being intoxicated in public is definitely not good for you, I would try to fight it off. You said you were not drunk, then how did you get intoxicated ticket? Parking ticket should not matter but you can fight that one too. Generally a ticket for indecent act is give for something that is done similar to yours with no precaution taken by yourself, ex. doing it in public with people around you. If this was a park, night time, you parked further away and tried not to be seen then he cannot give you a ticket for indecent act (which is why he did not). Take it to court and concentrate on fighting off the ticket for being intoxicated, maybe higher a paralegal or something to help you with that one.

Ticketed for fooling around by moral police!
Interesting experience last night, was out at a party last night and hooked up with a girl. Driving her back from downtown I decided to stop at Stanley Park to watch the moonlight and water. Anyway's we started fooling around and things got a bit hot and while we were on the backseat in comes a Cop with lights flashing but no siren. After asking us to put our clothes on and step outsides, he starts with all the questioning, name, age, relationship, nature of visit etc. Then he gave a ticket for $115 for illegal parking between 11-7, and issued her a ticket of $115 for intoxicated in public.
To me this is a matter of principle than anything else, he was being such an old schooler and uptight about the whole thing and rain down on our parade. At one time he even suggested calling her parents for a ride and unnecessarily freaking her out which is BS since I wasn't drunk. I asked him to cut me some slack and he said he already did by not giving a section 173 for indecent act which is like 2 grand? I dont even know how did he showed up there, must have been the old couple jogging their dog.
Anyway's, I have no problem in paying off both tickets but just wondering if this is going to be on a record as in a criminal offence? If I decide to dispute, what are the steps and do you think I have a case?

She got the intoxicated in public ticket, I wasnt drunk. Apparently after all the usual questioning, he asked both of us if we had any drinks. She was being honest and said yes, even though she wasn't stumbling around or causing any disturbance, and was infact not actually out on public street. I know both tickets can be contested, since I wasnt parked either, I was actually in the Car so it wasnt like my car was unattended either. If the intoxicated ticket is a cause of concern for one's record then Im definately going to fight it, will dispute it at ICBC center and see what happens.

I'd fight them both.
You were inside your vehicle. Was it running? if so, you weren't parked. In fact, I'd argue that you weren't parked even if it wasn't running, assuming you were in the car.
Also, your vehicle is not public property. Therefore your 'friend' wasn't intoxicated in public.
Seriously, go fight it, talk to the Crown Prosecutor and see if they will be more reasonable than the cop was.

Thanks. Thats how I see it too, but I really didnt wanted to argue with him and get him mad since the last thing I wanted was being tasered and arrested. I already figured there and then that I rather dispute when the time comes. The car was running with heater on and it wasnt like we were running around naked on the street, it was a relatively dark place in the middle of the park, and both of us were extremely civil, she wasnt drinking or driving and was above legal age. To be honest it seemed more like he had already decided to give us something without letting us go, and he wasnt able to figure out what to do.
Im just looking for experience if anybody else had success too, hopefully they drop it all together without the need to go to court since I dont know the girl very well either to carry along till the court date.

Sounds like you have a good case. It's good you are polite to the cop, generally you don't want to show attitude as that will only make your case worse. Just because he gave you ticket does not mean that he will not drop it, generally it is done so that he shows that something was done in regards to complaint received (if there was a complaint). I believe you have to apply for court either way, make you sure you do so while time permits....I believe there is a time limit on how long you have, probably says that on the back of the ticket. I would arrange a meeting with the crown either way and see how strong they feel about your case, depending on that you will get the idea if you need further assistance from legal sources (if you want).
I have a feeling they will offer to drop intoxicated ticket if you pay the parking ticket, which is not too bad of a deal. Up to you to take them on the offer or go further.Last edited by Andro; Feb 8th, 2012 at 11:43 AM.

Me too, I have done this before, never came across such hardball before, he actually took it quite personal it seemed. First he wanted to notify her parents by calling for a ride but then backed down. Then he made us stand outside near the car, while he went in his car to write the tickets and took forever, while we were shivering all that time.

Ignore as I was replying if you were in Stanley Park in Toronto.
Missed the whole water part.
That said, what I was writing still stands true in regards to the park thing. Stanley Park is public property (not a private street as some seem to state) and almost every city has bylaws indicating that you cannot be in a park and also not park in a park between the hours of around 11/1130 to 6/7am.
The intoxicated in public ticket sounds a little funkier because she was in the car, not driving, a passenger and did not get out and cause a disturbance. That is the one that should be fought.
Next time, go to a hotel, or a house. Making out in a car in a public park is just soooo cliche. That said... She was drunk...Last edited by dibksbgon; Feb 8th, 2012 at 12:06 PM.
