hi Redflag,
Few days ago I posted an ad on kijiji for an art-deco fireplace that has been removed from my mother house when renovating the basement.
I requested that anyone that want to take the Fireplace have to take some junk that also in my garage "a box of kitchen utensils and 4-wooden-pallets".
Many people called, man name “Trevor” agreed that he will take the fireplace and also the junk. He asked me for the address and when I will be at the house, and so on. I gave him all the details about where the fireplace was and what junk to take away.
He told me that he will send a junk removal guy to pick up the fireplace and rest of the junk. Also told me that junk removal guy will call me to coordinate the timing for pick up. So I waited for call no call came. I assumed he’s running late and I left the house and came back about 30 min later, when I came back, for my shock the fireplace was gone.
He or someone he knows came to my house without calling or notifying me, opened my garage while no one was at the house and took the fireplace.
Now I don’t know what to do, I feel like I have been violated and robbed; First he did not tell me that he was at the house, he took the fireplace and left the junk.
SO MY QUESTION IS WHAT I CAN DO TO GET THE JUNK REMOVED OR TO GET THE FIREPLACE BACK.
I have tried calling him few times; he tells me that he will send the guy to pick up the junk but never did. It has been a 5 days since this incident happened and I still have the junk in my mom’s garage.
Thanks for the help; for my proofs I am leaving a link for the message he left on my answering machine, and picture of the fireplace and junk.

Call the police immediately. That person should not have entered into your house without permission, that's very illegal. Call the police and give them all the information you have on this person.

Trevor BROKE into your house and STOLE the fireplace. Call the police, provide rfd + cellphone info, have him arrested, press charges, get the fireplace back.
hmmm* from the phone msg he sounded like a decent guy, perhaps it could be a miscommunication between the 3 parties. However, not responding to your phone call, and breaking into your house is unacceptable!

Adding to the consensus. Coincidence, I was thinking about this scenario last week and here it is: advertise something in trade for taking junk with it....person only takes the good thing and leave the junk.
It is theft. Contact the guy and tell him plain and simple that you will regrettably have to call the police and report the missing item as a theft if he does not immediately return the item or take the junk.

that is not even a lot of junk or messy junk. The guy was crazy to commit theft instead of taking it.

OP: posting the guys phone number probably is not going to fly. Think the said offender might get harassed?
I believe you but logic tells me you could just be doing a smart setup of the guy.
Call the police.

I don't see the police taking this very seriously or spending time/resources to charge someone for stealing something you were going to give them for free. They might get him for B&E but I wouldn't be surprised if they don't follow up or give you much attention. This case is an example of why I don't let people come to my house to buy things. I understand that in this case they person had to come but it might be best in the future to only give out your address at the time that they are coming and not before. I wouldn't be surprised if people get information such as address or when you will/won't be home and come by thinking they might find an open side garage door so they can steal the item instead of buying it. Don't ever mention that something is in the garage (unless its a car I guess) as it could lead to this type of thing. Was the garage door locked? How did they get in?

there's a lesson here, never give out your address advertising free stuff for pick up, what you should have done was give him the address of an intersection right next to your house where you guys can meet at a specific time

Checked out the local hot rods
Admired the chrome

Should have traded for the fireplace for a working garage door lock.
