So my wife was pulled over for going 20KM over the limit on Finch in 2009 and I requested a trial date. After about 8 months of no trial notice I called the number on the back of the ticket several times and the representative said it takes usually 1 year + before the notice gets mailed out due to the backlog. So we totally forgot about it and BAM yesterday she got a letter in the mail from MTO saying her licence was suspended due to unpaid fines.
I guess she got convicted in absentia of the speeding offense and a fine was handed out but somehow we never got the notice. I still have the original speeding ticket with the stamp at the back saying when I requested the trial date. I guess our options are either:
1) Pay the speeding ticket fine + MTO reinstatement fine and get her licence back
2) Request to reopen the case for a trial (But is this still possible at this stage and does her licence remain suspended until the trial is over)

I have had this happened to me in the past. Altho not the suspension part, but the notice of trial never came. Upon talking to the clerk, we're responsible to checking back if the notice never came as they dont mail it registered. At that point, i already missed my "trial date" and got convicted. I looked into the disputing with JP to reopen the trial but i found its a waste because i had no ground to reopen the case.
I think your option now is to pay the fine and get her licence back. Prepare to be bothered when you renew/switch your insurance tho...

UPDATE: We went to court yesterday fully prepared to pay for the ticket and any fines associated with it but the court staff said don't bother paying and he talked to the JP to have the case reopened and said this is a charter violation. So she got her license back w/o having to pay the $150 reinstatement fee and we got a new court date in November of this year. Time to fight it!!
