I've tried to explain it the best I remember. Perhaps you could call them and ask for clarification.
As for my box itself it is hard to tell whether it has been opened or not. It's not a normal box in the sense that it's secured by tape or staples. The box is in two parts. Part one is the lid which comprises most of the box. It is secured to the second part, a short base, by four square plastic brackets that are reusable. The documentation, cables and inner packaging don't seem to have been disturbed.
Now that I've gone over my tv for a few hours I now think perhaps it was an open box, in the conventional sense. I'm missing one piece of the contents that the manual says I should have: a “Vizio soft cloth” to clean the screen.
Oh well, I've got the one year warranty to ease my peace of mind.
One note of caution: IIRC my receipt says something like it's a Final Sale and No Refund.

They asked me how I found out about the deal: RedflagDeals or Ebay. I answered Redflags and they asked me to give the thread a good rating if I was satisfied with the experience but not to tattle-tale on the price I paid.
I will say this, there is room for haggling. Louis does the car salesman routine by putting me on hold and confirming/asking permission from his manager.
If you only want to negotiate the instore cash price (649.99 with 90-day warranty) the manager won't budge much if at all. I got the one-year warranty and he was willing to move a bit (hint: mid-single digits as a percentage off of total price).

$720 minus 5% = approx. $684 plus taxes.
Tempting but, the open box worries me (returned for sure-sorry but no one will ever convince me otherwise). A retailer will not advertise "open box" unless they absolutely have to - meaning, if they are really new, they will advertise it that way and explain the lack of support, blah, blah, blah.
I'd get the 42 over the 37 for sure.

I'm coming around to your thinking in that I think the tv I bought is probably refurbished. I've noticed scuff marks on the black part of the bezel like the tv has been clamped open. I used some car wax and buffed it back to glossy condition.
Generally speaking is it really that bad buying a refurbished tv?... assuming the factory correctly fixed whatever was wrong with it. I've been reading up on the official thread for this model at the AVS Forums and it appears I have the latest version of the VX37L, the 10A model, mine being manufactured in APRIL 2007.
Oh well, the price was right and I'm very happy with this lcd. It's everything I could have asked for, DiscoveryHD and HDNet look awesome. If something goes wrong in the next year I guess I have some recourse with the one-year warranty.
