Who is responsible for damage done while towing?

A lot of modern AWD cars use oil pumps for their diffs. Take a look at any Haldex equipped AWD car like VWs, Volvo, etc.



Do you understand the concept of backdrivability in mechanics? Vehicle drivetrains are not very backdrivable. Meaning they are intended to be driven by the motor to turn the wheels, but not the other way around. There is a lot of resistance when trying to backdrive the other way, which translates to stress on the gears and the shafts and all the components connected in the drivetrain.

An analogy is like a worm gear meshing with a spur gear. You can turn the worm gear to rotate the spur, but you can't turn the spur to rotate the worm gear. This is zero backdrivability (the extreme). Car drivetrains vary in design, but they are all not designed to be backdrivable by turning the wheels. They are intended for the engine to turn the wheels.

Does pulling an AWD on 2 wheels while letting the other 2 spin work? Evidently it shows it's spinning. But the stress you're putting on the system is great.

Please don't pretend to be an expert just because you change your own oil.
My diffss are mechanical as are most diffs. If you look at the video the wheels are freely spinning meaning the transmission is more than likely in neutral, the engine is completely taken out of the equation.

Vehicle was parked illegally. Only access to the vehicle, for removal , was via the rear. Car was only moved a sufficient amount to reposition for proper towing. Then was towed.

There should be no fault to the tow truck operator for damages in these type of situations. Car parked illegally and needed to be removed. No other way to do it.

If this type of removal was not sanctioned, then any vehicle owner could park wherever they liked with impunity saying you can't tow my car because you may damage it.

If you park illegally, you take your chances.

Now saying that, I have see a stolen vehicle that have it's wheels removed, simply dragged up onto a flat bed tow truck which literally wrote of the vehicle as tore undercarriage to hell.

Tow company in that type of situation, could have other methods of recovery.
