12 DAYS OF CHRISTMAS TRIVIA CONTEST

OFFICIAL RULES

1. NO PURCHASE NECESSARY TO PLAY OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

2. ELIGIBILITY. Crabtree & Evelyn’s 12 Days of Christmas Trivia Contest (the “Game”) is open to legal residents of Canada (outside of Quebec) who are at least 18 years of age as of the date of entry and who are physically located and residing in Canada. Employees of C&E Canada Inc. and its parent, successor, affiliate, and subsidiary companies (“Releasees”) as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee (whether related or not) are not eligible to play, enter, or win.

3. SPONSORSHIP. C&E Canada Inc. is the sponsor of the Game (“Sponsor”). The Game is in no way sponsored, endorsed, administered by, or associated with Facebook. By participating, you understand that you are providing your information to the Sponsor and not to Facebook.

4. HOW TO REGISTER AND PLAY. You must play the Game through the 12 Days of Christmas Trivia Game application that appears on the Crabtree & Evelyn Canada Facebook page. Any other form of play is void. Access the application by going to www.Facebook.com/CrabtreeandEvelynCanada. You will be asked to complete and submit an online registration form including your first and last name, email address (associated with your Facebook account), and date of birth, and to check the box confirming that you have read and agree to these Official Rules. You will be required to “Like” the Crabtree & Evelyn Canada Facebook page prior to playing. Once registered, you will be presented with a 12 Days of Christmas trivia question. You can enter once each day starting at 7 a.m. on December 12, 2012 and ending at 12 p.m. on December 23, 2012 (“Contest Period”). Limit one Game play per person per day. Game Plays made with the same or multiple Facebook IDs, under same or multiple identities, or through the use of any agent or other device or artifice to play multiple times in a day will be deemed invalid and the player will be disqualified.

5. DETERMINATION AND NOTIFICATION OF WINNER.

Daily Winner. Each day during the Contest Period one prize winner will be selected randomly by a computer from among the entrants who correctly answered that day’s trivia question.

Grand Prize Winner. On December 24, 2012, one grand prize winner will be selected randomly by a computer from among all the entrants who correctly answered at least one of the trivia questions during the Contest Period.

Notification. Winners will be notified once within 48 hours of the random drawing by email using the address provided during registration. If the notice fails to reach a winner for any reason, that winner will be disqualified. If a winner (a) fails to respond to the email prize notification within 48 hours of the time the email was transmitted or attempted to be transmitted to the winner, (b) fails to sign and return an an Affidavit of Eligibility, Liability, and Publicity Release, and any appropriate tax documents within 10 days of the transmission of those documents, (c) rejects the prize, or (d) fails to comply with these Official Rules, then, in any of those cases, the winner will be disqualified and the prize will be forfeited. If a prize winner or grand prize winner is disqualified for any reason the Sponsor may (but is not obligated to) randomly select an alternate winner from all remaining eligible, correct entries. Only one alternate drawing may be held, after which the prize will not be awarded.

6. ODDS OF WINNING. Odds of winning will depend on the number of players who correctly answer each day’s trivia question.

7. PRIZES.

Daily Prizes. One daily prize will be awarded per day during the Contest Period to a randomly selected winner. Daily prizes will consist of one of the following:

• Golden Fig Prize; approximate retail value of $72.00 (consisting of eau de parfum, body mist, body nectar, and body wash)

• Golden Petals Prize; approximate retail value of $72.00 (consisting of eau de parfum, body mist, body nectar, and body wash)

• Winter Garden Prize; approximate retail value of $133.00 (consisting of home fragrance oil, room spray, candles, and diffuser)

• Noel Prize; approximate retail value of $133.00 (consisting of home fragrance oil, room spray, candles, and diffuser)

• Ultimate Luxuries Prize; approximate retail value of $90.00 (consisting of a Lily “Ultimate Luxuries” gift set)

• Botanicals Prize; approximate retail value of $87.00 (consisting of an Avocado, Olive & Basil carry case gift set, a Citron, Honey & Coriander “Little Luxuries” gift set, and a Pomegranate, Argan & Grapeseed “Little Luxuries” gift set)

Grand Prize. One grand prize will be awarded on December 24, 2012 to a randomly selected winner. The grand prize will consist of one of each of the daily prizes. The grand prize has an approximate retail value of $587.

Prizes will be shipped to a Canadian only. All federal, state, provincial, country, and local taxes (if any) and any other costs not specifically stated within these Official Rules are the sole responsibility of the winners. Prizes are not transferable and no substitutions or cash equivalents are permitted, except that Sponsor at its sole discretion may substitute the prize with a prize of comparable or greater value.

8. GENERAL. By playing the Game, you acknowledge that you have read, understand, and unconditionally agree to be bound by these Official Rules and agree to be bound by the decisions of the Sponsor relating to the administration of the Game and the selection of winners, which decisions are final and binding. Sponsor reserves the right, in its sole discretion, to cancel, terminate, suspend, or modify the Game at any time without notice, if in Sponsor’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Game, or if a virus, bug, non-authorized human intervention, or other cause corrupts or impairs the administration, security, fairness, or integrity and proper play of the Game.

9. PUBLICITY. By accepting a prize, winners consent to the use of their names, images, likenesses, photographs, voices, and biographical material for advertising, publicity, and promotional purposes by Sponsor, or party designated by the Sponsor, in any and all media now or hereafter devised, including but not limited to, any online announcements, worldwide in perpetuity, without additional compensation, notification, or permission, except where prohibited by law.

10. LIMITATION OF LIABILITY. UNLESS PROHIBITED BY LAW, BY REGISTERING OR ACCEPTING A PRIZE, ENTRANTS RELEASE AND AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS RELEASEES AND FACEBOOK FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, LOSS, AND LIABILITY OF ANY KIND RELATING TO OR ARISING OUT OF THE PARTICIPATION IN OR ADMINISTRATION OF THE GAME, OR ACCEPTANCE, USE, OR MISUSE OF ANY PRIZE AWARDED. Releasees are not responsible for lost, late, misdirected, inaccurate, incomplete, undelivered, damaged, delayed, or garbled Game plays, notifications, claims or entries; or for any other errors or problems of any kind, whether typographical, printing, mechanical, human, electronic, or otherwise, relating to or in connection with the Game, including, without limitation, any error or problem that may occur in connection with the administration of the Game, the processing of Game plays/entries, the announcement or the awarding of the prizes, any errors in administration, notification or fulfillment, or in any Game-related materials. Entrants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Game.

11. LIMITATION OF DAMAGES. IN NO EVENT WILL SPONSOR, RELEASEES, OR FACEBOOK BE LIABLE FOR DAMAGES OR LOSSES OF ANY KIND, WHETHER DIRECT OR INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE, ARISING OUT OF ENTRANT’S PARTICIPATION IN THE GAME, OR THE ACCEPTANCE OR USE OF ANY PRIZES.

12. LIST OF WINNERS. For a list of the names of all winners, available approximately two weeks after the end of the Contest Period, write to: C & E Canada Inc., 546 Sovereign Road, Unit A, London, Ontario N5V 4K5, Attn: Marketing Department.
