This contest is open to Canadian residents (EXCLUDING RESIDENTS OF QUEBEC) only and is governed by Canadian law
1. CONTEST PERIOD:
The PetSmart’s Best in Show Contest with Royal Canin (the “Contest”) begins on August 7, 2017 at 9:00am EST and ends on September 17, 2017 at 9:00pm EST (the “Contest Period”).
2. ELIGIBILITY:
The Contest is open to residents of Canada (excluding residents of Quebec) who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are living, whether related or not) of Royal Canin Canada Company (“RC”), PetSmart, Inc. (“PM”) (collectively, RC and PM will be referred to as the “Sponsor”), their respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and/or any other entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Contest Parties”).
3. HOW TO ENTER:
No purchase necessary. There are two (2) ways to enter the Contest, respectively as follows:

PURCHASE ENTRY: To enter via an eligible purchase, you must visit a participating PetSmart retail store in Canada (a “Participating Store”) during the Contest Period during its regular operating hours and purchase any Royal Canin product (each, an “Eligible Product”) and have the cashier swipe your Pet Perks card (each, a “Card”) at the time of purchase (collectively, an “Eligible Purchase”). If you perform an Eligible Purchase in accordance with these Official Contest Rules (the “Rules”) (as determined by the Sponsor in its sole and absolute discretion), you will automatically receive one (1) entry (an “Entry”).
MAIL-IN ENTRY: To enter without having to complete an Eligible Purchase, you must hand-print your first name, last name, telephone number, valid email address and full mailing address on a 3” x 5” card, and include a 50-word (or more) handwritten unique and original essay on “Why I want to attend the 2017 AKC National Championship presented by Royal Canin?” (an “Essay”) and mail these materials in an envelope (with sufficient postage) to: PetSmart’s Best in Show Contest with Royal Canin, Match Marketing Group, 5225 Satellite Drive, Mississauga ON, L4W 5P9 (collectively, a “Mail-in Request”). In order to be eligible, your Mail-in Request must be postmarked during the Contest Period and must be received at the address provided above no later than October 6, 2017. No mechanical reproductions are permitted. Mail-In Requests become the property of the Sponsor and will not be acknowledged or returned. Each Mail-in Request must be mailed in a separate envelope bearing sufficient postage (i.e. mass Mail-in Requests in the same envelope will be void) and must include a unique and original Essay. If you perform a Mail-in Request in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), you will automatically receive one (1) Entry.
4. ENTRY LIMIT:
If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses, mailing addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. Your Entry may be rejected if (in the sole and absolute discretion of the Sponsor) your Eligible Purchas or Mail-in Request (as applicable) is not performed and received in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion). The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete, illegible or incompatible Eligible Purchases and Mail-in Requests (all of which are void).
5. VERIFICATION:
All Eligible Purchases, Cards, Mail-in Requests, Essays, Entries and any other information submitted in connection with this Contest (collectively, “Contest-Related Information”) and entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest-Related Information submitted (or purportedly submitted) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion). The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).
6. THE PRIZES:
There will be one (1) grand prize (the “Grand Prize”) and four (4) secondary prizes (the “Secondary Prizes” and, together with the Grand Prize, the “Prizes”) at the start of the Contest.
The Grand Prize consists of the confirmed winner’s selection of either: 1) $5,000 CAD (the “Money”); or 2) a trip to the 2017 AKC National Championship (the “Championship”) presented by Royal Canin taking place on December 16 and 17, 2017 in Orlando, Florida (the “Trip”). For greater certainty and the avoidance of doubt, the Grand Prize consists of the Money OR the Trip, not both. That is to say, the confirmed winner will be required to select to receive the Money or the Trip and in no event will the confirmed winner be eligible to receive both the Money and the Trip.
If selected, the Money will be awarded in the form of a cheque and must be accepted as awarded.
If selected, the Trip includes: (i) two (2) tickets to the Championship (subject to the terms and conditions of the issuer); (ii) round-trip economy airfare for two (2) people to Orlando, Florida from the major Canadian airport nearest to the winner’s residence (as determined by the Sponsor in its sole and absolute discretion) departing on December 15, 2017 and returning on December 17, 2017; (iii) two (2) nights hotel accommodation in a hotel (hotel to be selected by the Sponsor in its sole and absolute discretion). The total approximate retail value of the Trip is $5,000 CAD based on a Toronto hypothetical departure example. Without limiting the generality of the foregoing, the following terms and conditions apply to the Trip: (i) the Trip must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsor’s option; (iii) all travel related to the Trip must be completed on the dates specified above (otherwise the Trip may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed winner and his/her guest must: (a) travel on same itinerary; (b) have all necessary documentation to permit travel; and (c) must not have any legal barrier to travel to, and return from, the United States of America; (v) the costs of everything not specifically and expressly stated above as included in the Trip are the sole and absolute responsibility of the confirmed winner and his/her guest, including, without limitation: transportation for the confirmed winner and his/her guest to and from the Canadian departure airport; excess baggage and other fees; and items of a personal nature (NOTE: the confirmed winner may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if the confirmed winner and his/her guest do not utilize any part(s) of the Trip, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Trip or any component thereof; and (b) substitute the Trip or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) all travel arrangements relating to the Trip must be made through the Sponsor or its designated agents; (ix) by accepting the Trip, the confirmed winner agrees to waive all recourse against the Released Parties if the Trip or a component thereof does not prove satisfactory, either in whole or in part; (x) neither Sponsor nor any of its prize suppliers will replace any lost or stolen tickets; (xi) the confirmed winner’s guest must: (a) be a Canadian resident that has reached the legal age of majority in his/her province/territory of residence; and (b) sign and return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Released Parties relating to his/her participation in the Trip (including, without limitation, any travel related thereto); (xii) any difference between the actual value of the Trip and its stated approximate retail value will not be awarded; (xiii) all characteristics and features of the Trip (and of each Trip element), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (xiii) precise travel arrangements are subject to space and flight availability and shall be made at the Sponsor’s sole and absolute discretion; (xiv) once booked, travel arrangements may not be changed by the Trip winner; (xv) certain blackout dates and further restrictions may apply; (xvi) the Released Parties will be in no way responsible in the event that any part of the Trip is delayed, cancelled, postponed or rescheduled for any reason whatsoever; and (xvii) Sponsor is not responsible in the event a confirmed winner and/or his/her guest are unable to travel for any reason, in which case, the Trip will be forfeited nothing will be provided in its place.
Each Secondary Prize consists of a $50 CAD PetsMart gift card (which is subject to the terms and conditions of the issuer). Each Secondary Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Secondary Prizes with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. The number of Secondary Prizes available to be won will decrease throughout the Contest as they are awarded in accordance with these Rules.
Limit of one (1) Secondary Prize per person and per household.
7. WINNER SELECTION PROCESS:
On each of the dates listed in the table below (each, a “Secondary Prize Draw Date”) in Mississauga, Ontario at 11:00AM, one (1) entrant will be selected by random draw from among all eligible Entries received in accordance with these Rules prior to the corresponding Entry deadline (each, an “Entry Deadline”) and each such selected entrant will be deemed a potential Secondary Prize winner. The odds of winning a Secondary Prize depend on the number of eligible Entries received in accordance with these Rules prior to the applicable Entry Deadline.

On October 9, 2017 (the “Grand Prize Draw Date” and, together with the Secondary Prize Draw Dates, the “Draw Dates”) in Mississauga, Ontario at 11:00AM, one (1) entrant will be selected by random draw from among all eligible Entries received in accordance with these Rules and such selected entrant will be deemed the potential Grand Prize winner. The odds of winning the Grand Prize depend on the number of eligible Entries submitted and received in accordance with these Rules.
8. WINNER NOTIFICATION PROCESS:
The Sponsor or its designated representative will make a minimum of three (3) attempts to contact each selected entrant (using the information associated with his/her Card or Mail-in Request, applicable) within five (5) business days of the applicable Draw Date. If a selected entrant cannot be contacted within five (5) business days of the applicable Draw Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).
9. WINNER CONFIRMATION PROCESS:
Before being declared A CONFIRMED PRIZE winner, each selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the applicable Prize (as awarded); (iii) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the applicable Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant).
10. GENERAL CONDITIONS:
All Contest-Related Information becomes the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of any Contest-Related Information and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
The Released Parties will not be liable for: (i) any failure of a Card during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, mail delivery, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest-Related Information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.
In the event of a dispute regarding who should receive an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to allocate the Entry to the authorized account holder of the Card (as determined by PM in its sole and absolute discretion on the basis of its records) or email address submitted as part of the Mail-in Request (as applicable). In relation to an email address, “authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. In relation to an email address, an entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of such email address.
The Sponsor reserves the right, at its sole and absolute discretion, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, at its sole and absolute discretion, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted in connection with this Contest for the purpose of administering the Contest and in accordance with RC’s privacy policy (available at: http://royalcanin.ca/about-us/priva...) and PM’s privacy policy (available at: http://www.petsmart.ca/help/privacy.... This section does not limit any other consent(s) that an individual may provide RC, PM or others in relation to the collection, use and/or disclosure of their personal information.
The Sponsor reserves the right, at its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Contest-Related Information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to point of sale, television, print or online advertising, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
