Well, I can sympathize with people struggling to make rent but two wrongs don't make a right and if business is illegal govt should ban/outlaw Airbnb province wide or country wide. Police should not refuse to enforce property rights.

You don't have property rights in Canada. You have a lease from the government that they'll honor as long as you follow their rules. Operate outside the law and you operate outside it's protections as well.

That's good to know but that still doesn't explain the actions of hamilton police since owner of the land is still alive and seems like living in same house. It's trespassing plain and simple. There is no reason for them to wait for court order to enforce trespassing laws. :facepalm:

I think the police may have their laws mixed up. They were probably told (and reminded daily) not to do any evictions without a court order, but forgotten about the part that is should fall under the Residential Tenancies Act. It's not often that an airbnb overstays and not pay.

Those neighbours must be a treat to have next door.

The police response is ridiculous, they will charge the homeowner with harassment if she changes the locks? wtF?

This is why involving the police in these matters is almost useless, handle it on your own. These people require some external 'motivation', never fails.

Total losers... they should be arrested. There are literally people in jail for stealing one piece of food from a grocery store. And then you have morons like this probably abusing the crap out of the property too. The police saying they will arrest the owner for changing the locks is the dumbest thing ever. Feel terrible for the homeowner.

The RTA is pretty clear on this:

Exemptions from Act
5 This Act does not apply with respect to,

(a) living accommodation intended to be provided to the travelling or vacationing public or occupied for a seasonal or temporary period in a hotel, motel or motor hotel, resort, lodge, tourist camp, cottage or cabin establishment, inn, campground, trailer park, tourist home, bed and breakfast vacation establishment or vacation home;


Disgusting people indeed and shocking that the police does not know their own laws. I would never rent out to someone though who is local and always make sure that tehir intention of renting is in line with what is considered "travelling or vacationing public".

Landlords and Tenants of Ontario

Look for it on FB groups. Non-stop entertainment between 2 parties. For the most part I side with the Landlords but I have to be honest there are some out there that are just inhumane and assholes.

It definitely goes both ways.

I've seen some gems out there. One memorable property (illegal multifamily rental) that I saw with a fellow RFD'er, the listing agent was literally getting attacked by one of the tenants who refused to give anyone access to the vacant unit. Not to mention the property had dog feces everywhere, cigarette butts, joint roaches, etc. I can still smell that basement.

Endless entertainment.

cause its a civil matter just same as if you cheque bounced on a kijiji deal. they should start a go fund me page for the landlord and all can donate.

When you add in the police told them (the owners or news crew) they could be charged with harassment. It’s clear somethings wrong with the role Hamilton cops are now ordered to play. Also seems the riff raff from the neighbouring unit seem to be with the trespassers.

Whether you like AIRBNB or not, it’s a clear meltdown of laws and how they are enforced.
