California sues Activision Blizzard for sexual harassment and discrimination against women

The lawsuit describes a "frat boy" culture where male employees behave inappropriately.

Activision Blizzard has been sued by the California Department of Fair Employment and Housing because of its reported failure to handle sexual harassment and discrimination against female employees.

The DFEH held an investigation into the company that lasted over two years and has concluded that it “found evidence that [Activision Blizzard] discriminated against female employees in terms and conditions of employment, including compensation, assignment, promotion, termination, constructive discharge and retaliation.”

Just a few of the more extreme examples:
  • ‘cube crawls’ in which “male employees drink copious amounts of alcohol as they ‘crawl’ their way through various cubicles in the office and often engage inappropriate behaviour toward female employees
  • male employees proudly come into work hungover, play video games for long periods of time during work while delegating their responsibilities to female employees, engage in banter about their sexual encounters, talk openly about female bodies, and joke about rape
  • a female employee committed suicide during a business trip with a male supervisor who had brought butt plugs and lubricant with him on the trip. The suit alleges that at a holiday party before her death, male co-workers were passing around nude photos of her.
  • a female employee working on a game team who had taken on some of the roles of a manager: when she asked to be fairly paid for the extra work she was doing, she was told the company “could not risk promoting her as she might get pregnant and like being a mom too much

We always knew that Activision upper management were a bunch of scumbags, but this is next level disgusting. I hope criminal charges come to some of these people.

With what's been happening recently at Riot Games and Ubisoft, you would think management at these companies would crack down on these behaviors, but obviously they don't learn...

Yeah, just horrible. But it's not like this is new to Activision, or the industry as a whole. This is just a more extreme case.

Bobby Kotick already lost a sexual harassment case a while ago. It isn't any surprise that many in AB have the same mentality. Kotick fired a ton of people and made $200+ million just recently, so what's the incentive to change. Probably just throw around a few millions to make it go away...

Hopefully this isn't just another case of media, people in the industry, going this is horrible, but then do nothing about it. I hope people are charged. I hope action is taken against AB, instead of just lawyers massing up to make it disappear. Also, I hope people in the industry actually do something about this type of thing, instead of just the internet outrage and then silence.

A friend of mine used to work at Blizzard in the WoW glory days and he told us stories about how guys like Chris Metzen used to end up loaded in managers offices and then sleep it off. Unfortunately I'm not surprised at the pub crawl allegations given the culture there. I noticed that Metzen and other ex Blizzard guys are already name searching themselves on Twitter and trying to get out in front of any accusations with pre-emptive apologies. "Oh geez so sorry this happened on our watch etc etc"

Activision's lack of a serious response is pretty pathetic too and what's even sadder is that their stock already rebounded because CoD bux and all that. I don't really buy many Activision products these days and definitely will be holding off unless they can offer a credible plan to improve things.

I dumped my Activision shares around end of February and about a month later bought AMD. Boy did I dodge a bullet.

Yeah, Metzen and the others with their fake apologies. Suddenly caring and sympathetic just because it's out in the open now. Actions over words every time.

Axing Brack is a start, but it's still just a band aid. You've still got Bobby Kotick at the top still running the show. As long as he's there, nothing is going to really change. You can't have that POS, directing how equality, sexual harassment, and discrimination should be handled. It's still the worst guy at the top saying don't worry, we'll make sure we take care of our people.

Was really looking forward to Diablo 2 Remaster, but now can't honestly bring myself to support them. Pre-order cancelled. This is disgusting behaviour and hits home all the harder when you have a daughter at home. If this was her work environment in another few decades, you can bet I'd be pulling that place down brick by brick myself.

I have two.

I don't see this problem being gone in a few decades. Not to politicize this much, but just read some of the commentary on RFD, and especially this specific forum itself, and I see a lot of men who really don't get it. Video games are really a harbour for a lot of insecure chauvinists.
For example, I notice lots of commentary in this forum focuses on how some games (ahem and movies) have too many female characters, or females characters that look "butch", or old, or just not "sexy". Or was written, produced, or directed by a female. When we don't speak out against the people who promote obvious gender-bashing commentary, then we are like the bystander employees of Activision-Blizzard.
The real solution to AB's problem is probably Unionization, which forces gender equity. Historically, women have always been underpaid and exploited in many ways. Chances are our own mothers and wives had at least one job where they were ogled, underpaid, and/or harassed. I also know when previous situations have been brought up here, there are many regulars who start with "Yeah well my job is tough too, who cares about what some programming drone's problems are. They get paid, they can put up with it like me". In an industry that makes billions off our leisure, I say we should care more. How many Activision-Blizzards do we enable, and why exactly do they deserve your money?
I want to believe things will get better for my daughters. I often hope small proactive steps can help them, including challenging toxic posts.

I think it goes back to how for the longest time gamers were very ostracised. The thought process probably goes 'gamer/tech nerd never gets the girls back in high school' => 'gamer/tech nerd grows up idolising the jock/frat boy lifestyle' => 'gamer/tech nerd makes IT big bucks in gaming' => 'gamer/tech nerd starts their own version of the frat house and treats women horribly'. Will probably get better in the future as the newer, more enlightened generations take over. Hopefully.

Oh every step helps. The old jokes that dads patrol the house with shotgun in hand kinda misses the point that it was never really about protecting 'chastity' or whatever nonsense. It's actually because there are ALOT of creeps out there. I mean, this is harassment leading to workplace suicide and there are still people somehow supporting it and saying they'll buy MORE COD because 'she probably deserved it'. That's just psychopathic behaviour. And I thought the Ubisoft stuff was bad a while ago. ActiBlizzard can crash and burn and deserve it.

Maybe this is slowly changing but when I was in school 15 years ago for programming my class was about 98% men. My job is also primarily working with men. Also, even though there is more women gaming now, the community is still primarily male, especially, outside of a handful of games and genres which seem to attract a bit more women. So gaming is still a bit of a boy's club and the industry is filled with dudes that didn't go to school with women, didn't associate with many women in their hobby, and in general don't really know how to act around women. Sprinkle this with a bit of insecurity about "kill count" and you get this kind of stuff happening.

I'm in software myself but not gaming and I can honestly tell you that I don't see any of this where I work and if anything I'm sick of all the harassment and sensitivity training I have to do.

Yeah... This is exactly the type of thing I was saying I didn't want to happen, but figured would be the case. They lawyered up and put in charge the type of people you didn't want there, to "fix" things. I'm glad the unions are pushing against it. But I still don't think anything will change until Kotick and all his minions are axed and held accountable.

Whatever the crime, it's always California sues. It's the most litigious state in the USA with the most lawyers living there. If there is any violation, they want to try it in California as the payouts are generally higher. I had friends say that is the way to make your fortune in California...SUE SOMEBODY...

Yeah, the old days belonged to the old boys club. The scenes in a movie like Wolf of Wall Street weren't exaggerated at all in other places like Microsoft. Times have changed and it's time to pay the piper...maybe. But if you have unlimited money and good lawyers, maybe not...

A damning report by the Wall Street Journal claims Activision Blizzard CEO Bobby Kotick was aware of the allegations of sexual misconduct and mistreatment of female employees across many parts of the company "for years", yet failed to tell the board of directors and executives everything he knew.

It's claimed, for instance, Kotick was directly informed of allegations made by a Sledgehammer Games employee that a male supervisor had raped her in 2016 and 2017 after she was pressured into consuming too much alcohol in the office and at work events.

The same email to Kotick reportedly highlighted another incident in which a second Sledgehammer employee, Eduard Roehrich, had been accused of sexual harassment after a night of drinking in 2017. Speaking to the WSJ, Roehrich said the results of an internal investigation by Activision after the event resulted in two weeks of paid leave and the opportunity to remain at the company in a different position. Roehrich claims Activision HR requested he "keep this matter confidential" at the time.

Kotick is also said to have been aware of allegations aimed at Dan Bunting, co-head of Activision's Call of Duty studio Treyarch, in which a female employee accused Bunting of sexually harassing her after a night of drinking in 2017. An internal investigation in 2019 reportedly recommended Bunting was fired, but Kotick intervened to keep him.

Sent in the midst of historic allegations of harassment against the company, it was so bad that it was one of the direct, cited causes of a staff walkout.

Today, somehow, this email has returned and become even more explosive, with the Wall Street Journal reporting that Townsend didn’t even write it.

The email was one of the most tone-deaf, oblivious pieces of executive hand-waving you will ever see. It was sent right in the middle of allegations that shook a major publisher to its core, and led to a number of high-profile firings and resignations, dragging both Activision and Blizzard’s names through the mud for much of 2021. The email had the nerve to call the lawsuit sparking those moves as having “presented a distorted and untrue picture of our company.” It went on to say that Townsend was “proud to be part of a company that takes a hard-line approach to inappropriate or hostile work environments and sexual harassment issues,” despite everything that had just happened, and was about to happen.

Now the WSJ reports that it was in fact besieged Activision Blizzard boss Bobby Kotick who wrote it. The story says that Kotick, who “approves most internal companywide emails, as well as media responses,” drafted the email himself. He then directed that it be sent under Townsend’s name, likely because she was one of the few women executives at a company run predominantly by men.

An Activision rep responding to the WSJ’s reporting, saying Kotick now “takes responsibility for the incident and regrets it,” and adds, “Ms. Townsend should not be blamed for this mistake.” If you remember at the time, Kotick criticised the email as having been “tone deaf,” despite the fact that it now turns out he wrote it himself.
This guy is a total POS. But of course the board still 100% has his back and he's going nowhere. Keep buying COD people... The guy needs to be axed and everyone who works alongside or supports him needs to be axed as well.

Sony Group Corp.’s PlayStation chief Jim Ryan criticized Activision Blizzard Inc. Wednesday for the game publisher’s inadequate response to an explosive news article alleging that Chief Executive Officer Bobby Kotick was aware of sexual misconduct and harassment allegations for years and that he had also mistreated women.

In an email to employees reviewed by Bloomberg, Ryan linked to the Wall Street Journal’s Tuesday report. He wrote that he and his leadership were “disheartened and frankly stunned to read” that Activision “has not done enough to address a deep-seated culture of discrimination and harassment.”

Good to see the industry execs not sitting back. I know Phil Spencer is usually outspoken about this stuff, but good to see Jimbo do the same. Though I would like to see them do more than just talk the talk. They took Cyberpunk off the store page, maybe it's time do it for CoD. Even if its just for a weekend, it sends a message.

I don't know anything about Jim Ryan but I'm happy to see the industry in general putting pressure on the Activision board to oust Bobby Kotick. Literally threatened to kill someone for reporting sexual harassment, just unbelievable.
