Desjardins Privacy breach: $200m Class action settlement agreement submitted to the Superior Court of Quebec

Probably a few here were impacted:
How much is the settlement?
The settlement agreement submitted to the Superior Court of Quebec for approval allows for a maximum amount of $200,852,500 to be paid out as individual recovery to eligible individuals who file a claim.

Who can make a claim under the settlement agreement?
All individuals affected by the privacy breach announced by Desjardins on June 20, 2019, are included in the settlement agreement, namely:s

Current and former Desjardins banking members
Current and former clients with a credit card or in-store financing
Anyone who received a letter informing them of the situation
What kind of claims can be made?
You can file two types of claims under the settlement agreement:

If you were impacted by the situation announced in June 2019, you can claim up to $90.
If your identity was stolen after January 1, 2017, you can claim up to $1,000.

Not much more you can expect when this is a class action with millions affected. Those who were victims of actual identity theft are eligible for more. You can always opt-out and sue on your own.

Reminds me of the infamous Peoples Trust data breach back in the day that affected many RFDers.

However, no class action and no compensation.

Those were early days.

Ditto and to be paid out in July 2023.
IMO, getting free Equifax for 5 years is probably more worth it.

Read between the lines... Look at the maximum compensations and requirements and draw your own conclusions

Not sure if I qualify either. I used to be with desjardins but haven't been for years. Did not receive an email, no idea if I'm included in the breach or not (they say 9M members affected, that's pretty much QC's population...). I wouldn't say no to 5 years equifax free + 18-36$ for my time. However I have no intention of abusing this if I'm not qualified for it, not worth it.

I am not with Desjardins anymore but I was when the breached happened. If you received an Equifax code a few years ago, Desjardins will send you another letter about the settlement. I got it a few weeks ago. If you were not with Desjardins, they obviously won't send you anything and you can't get the money. Desjardins needs to have you in their database to be eligible, this is not like the Microsoft or DVD class action that don't check.

Don't be so quick in thinking you will get $90. I already received the confirmation that my claim was approved and it clearly state that next Summer (July 2023 if I remember) I MIGHT receive up to $90. If everybody makes claims there won't be enough money to get the full amount and you will get what is left.

This is a big slap in the face. Receiving $90 (or less) for having my info stolen forever (my SSN, date and place of birth, will never change, my address likely won't change for many years) is ridiculous. I am not even talking about punitive damages, it doesn't even cover the cost that will be uncured. A simple Equifax protection is $20 per month (without taxes), you can't even get a full year of protection with $90. Yes I know Desjardins gave me 5 years (I believe it was 5 years, which will end in 1 or 2 years I think) but my info didn't change and soon I won't be "protected" anymore. I think I read that they will continue to provide Equifax protection to current Desjardins customers after the 5 years but not for people like me that left them.
Try not! Do or do not, there is no try...

Just got an email. My "DESJARDINS CLASS ACTION has sent you $88.20 (CAD) and the money has been automatically deposited into your bank account at CIBC"

Waiting to see if wife gets the 1K we filed for as her account was hacked twice and we went through hell to fix things.

Just submitted my claim for identity theft today after delaying it for a while. I think the results of that round will only be paid out in 2024 right?

Did he report to Transunion/Equifax to have that call flag put on him?

Wow, that's brutal...That's a lawsuit right there. These class actions might absolve Desjardins of their sins though...while people get paid out peanuts. Couldn't we just get the leaker guy and tie him to a post like a punching bag in downtown Montreal?
