Enercare - Check your gas bill for unapproved charges

Moved properties and in the official listing and the sales agreement, no HWT rental. Got my first Enbridge bill and saw "charges by different company" and saw a Hot Water Tank rental for $40 a month by Enercare. So I think to myself, great, time to get my real estate lawyer involved, but better phone Enercare first to verify the rental first.

I phone Enercare, and after they get my story and info, place me on hold for 20 minutes, saying the hot water tank is not in their database. This CSR advised me they will send out a technician to look at the tank to see if its a rental. Get transferred over to the scheduling department and the call disconnects.

I phone Enercare again, they look at the database again, couldn't find anything. They ask if there are Enercare stickers/tags on my tank and I say no, feel free to send over a technician. Now they want section 6 of my Sales Agreement for the home purchase. I ask why. They said, if its listed under section 6 of your sales agreement then you have a rental and if its not on section 6, we will charge the previous owner. Except the owner passed away. All i can say is WOW. They even said, all they need is a picture of section 6, so sure, I send them section 6, which doesnt have any names, addresses or any info relating to the property. I even said the last CSR said they would send a technician to look at the tank, but this CSR declined and wanted section 6 only.

I tried posting 1 star reviews on google maps and it doesn't get posted, but they somehow have THOUSANDS of 5 star reviews. Just absolutely insanity how they can charge people via the gas utility company (Enbridge) with NO HOT WATER TANK RENTAL IN THEIR DATABASE. /rant.

Moral of the story: dont give Enercare any business, dont let your friends and family give them any business and keep spreading the Enercare factual scam stories.

In these cases, as a consumer, I hope you can directly call Enbridge and ask them to stop billing for any 3rd parties. If Enercare thinks they have a case to get paid, let them fight in courts. It should never be so easy for 3rd parties to simply tack on their bills to your gas or hydro bills.

Exactly. If Enercare sent their own individual bills, their business wouldn't be as large as it currently is, as people would just cancel or not pay the bill (unless the rental is legit of course). But by putting it with an utility bill, we are essentially forced to pay it if we want natural gas. Why would an utility company go out of their way to bill for a private company? How does this even benefit the utility company? And most importantly, how is this even allowed?

Its like Hydro One adding monthly charges on behalf of GreenON (or any other private company) for the smart thermostats that GreenON sold to you (not true, but just an example).

And I still have not heard back from Enercare yet.

It looks like, as the end result of business changes and acquisitions Enercare has the former Consumers Gas/Direct Energy (Enbridge) rental water heater portfolio. Or so it seems anyways.

Update: I called Enercare back a week ago and they said the rental was removed from their system, the charges should stop and I would get back 2 months of rental payments I made.

And I just received my bill from Enbridge and the $40 rental charge is still on the Bill from Enercare! I call them again today, and they ask me if I have a rental and if I submitted my sales agreement. And apparently I have a hot water tank rental now in their system!! I spoke to 4 agents total, and the first 3 said I DONT HAVE A HOT WATER TANK RENTAL. The 4th (today) agent said I have a hot water tank rental now in their system? WTF!!

Don't give ENERCARE your business!

I believe you can call Enbridge and get them to stop allowing the 3rd party charges if you explain why.

I am facing the exact same issue except my rental charge is $66 a month. I have talked to them a couple of times and the support representatives are absolutely clueless and have no idea how to fix the issue. I emailed them the purchase sales agreement which clearly doesn't have any hot water tank rental. It has been almost 5 weeks and no response at all. Unbelievable that this kind of issue takes so long to fix. Don't they have some kind of record that a hot water tank rental was installed on my property?

Meanwhile I have to keep paying my bills because it is tied to my enbridge account. SMH

New home or a resale home? If resale did the selling agent fail to put it in the sales agreement?

Ask the Enercare people what the serial number is for the rental and compare it to what's installed in your home.

Yes, it's maddening. They finally ended up removing the charges and giving me credit back.

You can also call Enbridge or whoever your utility company is, and tell them to pause the rental payment whilst you and the rental company find a resolution.

Good luck, you'll need it lol.

Same situation here, bought a house recently. House purchase agreement says no rental HWT. But I get charges on my 1st Enbridge bill from a small company. I contacted the company billing me for HWT on Enbridge bill to obtain info & buyout quote. They said that I have to assume the rental contract first before they will give me a buyout quote. They sent me the assumption form, which shows it is a 10 year contract for HWT from 2014-2024. They told me the contract was initiated by a person who is the deceased husband of the seller. Seller is a 60+ year old widow who has presumably left the country. Don't know if the HWT really belongs to this company as there are no stickers on the HWT from this company. Very frustrating, as I don't know what to do.

Are you sure its not in tbe purchase agreement? If it isn't you aren't responsible for the tank. The former owner is. The selling real estate agent is required to list rented property. You could contact your real estate lawyer that handled the transaction. If the rental company is on the up and up it might even be possible to send them a copy your sales agreement to prove you didn't assume the rental. I would also discuss this with the billing department of Enbridge if need be. You don't want to assume the contract.

The company should also be able to provide a serial number to prove they own it.

Agree with this. Do not assume the rental. Go through your purchase agreement first.

Step 1 call Enbridge and tell them to block and future 3rd party billing. Step 2 read your sales agreement front to back and make absolutely sure there are not statements or clauses about assuming and rentals (not specifically the water heater but anything) in there. Step 3 tell rental company to pound sand and demand return of all money taken (this may or may not actually work). Step 4 prepare to buy your own water heater and have it installed (find the type of heater you need to replace the current one and someone who can install it, have the fund ready to go).

Basically if the agreement doesn't state you are to take over the rental, you don't have to. BUT be prepared for a fight and possibly them wanting to remove your current water heater (in an attempt to get your to break and get back into a rental with them). Take note of any serial numbers on the tank and make sure you get them to provide you the EXACT same number and model of tank BEFORE you EVER let them see it (or the could just write it down and then tell it back to you).

Good luck. My last house I spent 2 YEARS fighting with Simple Green over double billing (they were charging me for TWO water heater rentals instead of the one I had). Eventually got back some of the money and sold the house.

100% sure - it's not in the purchase agreement. I contacted my lawyer as soon as I discovered the issue. My lawyer says he's reached out to the vendor's lawyer. Vendor's lawyer has been unable to reach the seller, because the seller has presumably left the country and they are unsure as to when she will be returning. Right now, I feel like my lawyer is not doing much or anything at all, and I am on my own to deal with this issue.

It is very confusing to me, as the company says the contract was signed in 2014. When I looked at the HWT in the basement and the gas tag attached, it suggests it was replaced in 2015. Seller had provided a handout with list of upgrades in which they show the HWT was replaced in 2017. I am so confused as to whether the actual tank in the basement even belongs to this company or not.

Again call Enbridge and get them to block any further payments from happening. Then contact the rental company and have them PROVE it's their tank in your basement. DO NOT let them see the tank until they provide you with the model number and serial number on your tank.

That's actually really good advice, if they cannot prove you have a certain tank with a SN/model then they dont have it on record & just want to come in to get that info & probably add it to your account.

I called Enbridge and they opened a dispute. The following day, I received an email from a manager at Simply Green (also called Crown Crest Capital) inquiring about my dispute. I plan to reply to the email by providing context. So you are saying that I should ask them details about the tank such as brand, model & SN? Previously, when I contacted their customer service dept, they sent me an assignment form which shows HWT was installed in June 2014. I inspected the HWT in the basement and there's a gas tag dated 2015 next to it. On the tank, it says owned by some company called Delta HVAC. All of this is very confusing to me. So I am not even sure if the HWT in my basement belongs to Simply. I just want out of this contract somehow. My lawyer is aware of the issue, but basically not doing anything. Should I file a title insurance claim for this? I believe your issue was also with Simply. How did you manage to resolve it? Thanks.

Edit: I read the purchase agreement again - seller declared that the HWT is owned.
