G2 Driver with a not at fault accident

Hello RFDers,

Today my sister was involved in an accident where someone side swiped her going down the road, there’s photo evidence that the accident is not her fault. She’s a fairly new driver and only has her G2, she got it last summer. Is there any chance her insurance will go up as a result of this?

It won’t / should not go up as long insurance company deems her not at fault at all. Just provide pictures as you claimed she has and forward to insurance for further proof when asked

Hopefully the photo evidence is convincing. Video evidence (dashcam) would be better. The fault determination rules say that if it can't be determined which vehicle was out of position in a sideswipe, then it's 50/50.

side swipes are tricky situation unless you have a dashcam because its usually a he said she situation where both parties are blaming each other

Yea I’ve told her to get a dashcam and I’ll make sure she will, I’ve had mike for years. The photos show her vehicle in its lane and his entire car half into her lane, I hope the positioning of the vehicles is enough proof due to the lack of dashcam footage.

Wasnt very serious, just light scraping along the front quarter, front door and rear door along with some damage to the mirror. An officer that was driving by stopped and asked if everyone was ok and stated that the other party was at fault.

That's great, you got an officer's statement of the accident! That will carry a lot of weight with the insurance company.

Just remember that it's not about serious or not, it's about a threshold of cost to repair. It seems like more than $2k worth of damage was caused - police should be called for a collision report.

She’s already gone to the accident reporting centre, they’ve estimated the damage at $1940
